Common use of Insurance Obligation Clause in Contracts

Insurance Obligation. TENANT UNDERSTANDS AND AGREES THAT, UNLESS TENANT PARTICIPATES IN THE LESSOR'S STORESAFE PREMIUM LEASE PROGRAM, ALL PROPERTY STORED WITHIN OR ON THE SPACE BY TENANT OR LOCATED AT THE FACILITY SHALL BE AT TENANTS SOLE RISK. UNLESS TENANT PARTICIPATES IN THE LESSOR'S STORESAFE PREMIUM LEASE PROGRAM, LESSOR SHALL HAVE NO LIABILITY OF ANY KIND FOR ANY LOSS WHATSOEVER THAT TENANT MAY HAVE OR CLAIM BY RENTING THE STORAGE SPACE OR BEING ON OR ABOUT THE FACILITY, AND, THEREFORE, TENANT MUST OBTAIN ANY INSURANCE DESIRED AT HIS/HER OWN EXPENSE. LESSOR IS REQUIRING THAT TENANT EITHER PARTICIPATE IN LESSOR'S STORESAFE PREMIUM LEASE PROGRAM OR THAT TENANT SECURE HIS/HER OWN INSURANCE TO PROTECT HIMSELF/HERSELF AND HIS/HER PROPERTY AGAINST ALL PERILS OF WHATSOEVER NATURE. EXCEPT AS IS EXPRESSLY STATED TO THE CONTRARY IN THE LESSOR'S STORESAFE PREMIUM LEASE PROGRAM, AND TO THE EXTENT TENANT PARTICIPATES IN SUCH STORESAFE PREMIUM LEASE PROGRAM, LESSOR SHALL NOT BE LIABLE TO TENANT OR TENANTS INVITEES, FAMILY, EMPLOYEES, AGENTS, OR SERVANTS FOR ANY PERSONAL INJURIES OR PROPERTY DAMAGE, OR LOSS FROM THEFT, VANDALISM, FIRE, SMOKE, WATER, HURRICANE, RAIN, TORNADO, EXPLOSION, ACTS OF GOD, OR ANY OTHER CAUSE WHATSOEVER. TENANT ACKNOWLEDGES THAT TENANT MUST TAKE WHATEVER STEPS HE/SHE DEEMS NECESSARY TO SAFEGUARD PROPERTY THAT IS AT THE FACILITY OR IN OR ON THE SPACE. TENANT MUST PROVIDE HIS/HER OWN LOCK AND KEY AND ASSUMES FULL RESPONSIBILITY FOR WHOMEVER HAS POSSESSION OF THE KEYS AND ACCESS TO THE SPACE. LESSOR SHALL NOT BE LIABLE FOR LOSS OR DAMAGE RESULTING FROM FAILURE, INTERRUPTION OR MALFUNCTION OF THE UTILITIES, APPLIANCES, OR FIXTURES, IF ANY, PROVIDED TO TENANT UNDER THE TERMS OF THIS RENTAL AGREEMENT. EXCEPT AS EXPRESSLY STATED TO THE CONTRARY IN THE LESSOR'S STORESAFE PREMIUM LEASE PROGRAM (AND SOLELY TO THE EXTENT TENANT PARTICIPATES IN SUCH STORESAFE PREMIUM LEASE PROGRAM) TENANT HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS THE LESSOR FROM AND AGAINST ANY AND ALL CLAIMS FOR DAMAGES OR LOSS TO PROPERTY OR PERSONAL INJURY AND COSTS INCLUDING ATTORNEY'S FEES ARISING FROM TENANT'S USE OF THE SPACE AT THE FACILITY, OR FROM ANY ACTIVITY, WORK OR THING DONE, PERMITTED OR SUFFERED TO BE DONE BY TENANTS IN OR ON THE SPACE OR ABOUT THE FACILITY. Should any of Lessor's employees perform any services for Tenant at Tenant's request, such employees shall be deemed to be the agent of the Tenant regardless of whether payment for such services is made or not, and Tenant agrees to hold Lessor harmless from all liability in connection with or arising, directly or indirectly, from such services performed by employee of Lessor. Tenant agrees to notify Lessor immediately upon the occurrence of any injury, damage or loss suffered by the Tenant or other persons on or within the facility. TENANT HEREBY AGREES TO PROVIDE LESSOR WITH PROOF OF INSURANCE COVERING THE TENANT'S PROPERTY DURING THE TERM OF THE TENANCY, UNLESS TENANT PARTICIPATES IN THE LESSOR'S STORESAFE PREMIUM LEASE PROGRAM IN THE EVENT THAT PROOF OF INSURANCE IS NOT PROVIDED ON DEMAND, OR IN THE EVENT THAT SUCH INSURANCE HAS BEEN CANCELLED, NOT RENEWED OR MATERIALLY CHANGED, LESSOR RESERVES THE RIGHT TO AUTOMATICALLY ENROLL TENANT IN THE STORESAFE PREMIUM LEASE PROGRAM OFFERED OR FACILITATED BY THE FACILITY FOR A PROTECTION AMOUNT OF $3,000 AT THE STANDARD ADDITIONAL RENT CHARGE FOR SUCH PROTECTION THEN IN EFFECT UNDER THE STORESAFE PREMIUM LEASE PROGRAM.
