Common use of INTERNET AND NETWORK Clause in Contracts

INTERNET AND NETWORK. Xxxxxx Solutions makes PbK available to Client through the Internet and/or Client’s own network and systems, to the extent commercially reasonable, and subject to outages, communication and data flow failures, interruptions and delays inherent in the Internet and network communications on the Client’s own network and systems. Client recognizes that problems with the Internet, including equipment, software and network failures, impairments or congestion, or the configuration of Client’s own computer systems and network, may prevent, interrupt or delay Client’s access to PbK. Xxxxxx Solutions is not liable for any delays, interruptions, suspensions or unavailability of PbK attributable to problems with the Internet or the configuration of Client’s computer systems or network.
