Common use of Introduction and Discontinuation Language Clause in Contracts

Introduction and Discontinuation Language. (a) Extended twelve (12) hour tours will be introduced into any unit on a trial basis of six (6) months when: i) a majority (50% + 1) of the Registered Practical Nurses in the unit so indicate by secret ballot their agreement; ii) the Hospital is able to provide a workable schedule; iii) the Hospital agrees to implement the extended tours. Such agreement shall not be withheld in an unreasonable or arbitrary manner; and iv) it does not affect client care adversely. (b) Extended twelve (12) hour tours may be discontinued in any unit when: i) a majority (50% +1) of the Registered Practical Nurses in the unit so indicated by secret ballot; or ii) the Hospital, because of (1) adverse effects on patient care, or (2) inability to provide a workable staffing schedule, or (3) a wish to do so for other reasons which are neither unreasonable or arbitrary, so states its intention in writing to the Union to discontinue the extended tours work week. (c) When notice of discontinuation is given by either party in accordance with paragraph (b) above: i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and ii) where it is determined that the extended tours work week will be discontinued, affected Registered Practical Nurses shall be given forty-five (45) days notice before the schedules are so amended.

Such agreement shall not be withheld in an unreasonable or arbitrary manner; and iv) it does not no affect client care adversely. (b) Extended twelve (12) hour tours may be discontinued in any unit when: i) a majority (50% +1+ 1) of the Registered Practical Nurses in the unit so indicated indicate by secret ballot; or ii) the Hospital, because ofHRM (1) adverse determines that extended tours adversely effects on patient resident care, or (2) inability is unable to provide a workable staffing schedule, or (3) a wish to do so for other reasons which are neither unreasonable or arbitrary, so states its intention in writing to the Union to discontinue the extended tours work week. (c) When notice of discontinuation is given by either party part in accordance with paragraph (b) above: i) the parties shall meet within two (2) weeks of the giving of notice to review the request for discontinuation; and ii) where it is determined that the extended tours work week will be discontinued, affected Registered Practical Nurses shall be given forty-five (45) days notice before the schedules are so amended.
