Investigation and Defense. Program Administrator will investigate, or cause to be investigated, all such claims and will attempt to adjust or settle such claims, in accordance with the authority delegated to Program Administrator by Board or the Participant involved. As required, and subject to the provisions of the Coverage Contracts, the Authority, through designated defense counsel will provide legal defense of claims against Participants. The Participant agrees to aid the Authority in such matters and to provide and make available all information and personnel as may be reasonably required in the opinion of Program Administrator to fully investigate and resolve the claim. It is understood that Board and Program Administrator shall use their discretion in making judgments and assumptions as to the actual value of any claim and making such reserves based on such judgments.

Except as provided in Article XVI Section 2 above, the Administrator will investigate, or cause to be investigated, all such claims referred to in the foregoing paragraphs and will attempt to adjust or settle such claims, in accordance with the authority delegated to the Administrator by the BETA Council and the Member involved. Each party to this Agreement hereby delegates such authority, subject only to the terms and conditions of the Group Self-Insurance Programs in which the Member participates. As required by, and subject to, the provisions of the Coverage Contracts, BETARMA, through designated defense counsel, will provide legal defense of claims against Members. The Member agrees to cooperate fully with BETARMA in such matters and to provide and make available all information and personnel as may be reasonably required in the opinion of Administrator to fully investigate and defend the claim.

Pursuant to its contractual arrangement with the Board, the Claim Administrator, as identified in Article X, below, shall investigate all claims and shall attempt to adjust or settle such claims. The Pool members shall fully cooperate with and provide and make available to the Claim Administrator and assigned legal counsel all information, assistance and personnel as may be reasonably required in the opinion of the Pool Administrator, the Insuring Company, the Claims Administrator or such legal counsel to fully and properly investigate and defend any claim or loss.

Administrator or its agent shall investigate, or cause to be investigated, all such Claims referred to in the foregoing paragraph and shall attempt to adjust or settle such Claims. As required and subject to the provisions of the Coverage Contract, XxXXX, through its designated counsel will provide legal defense of Claims against Members. The Member agrees to aid XxXXX in such matters and to provide and make available all information and personnel as reasonably may be required in the opinion of Administrator to investigate and defend the Claim.

As required and subject to the provisions of the Coverage Agreement, ALPHA Fund, through its designated counsel, will provide legal defense of claims against Participants. The Participant agrees to aid ALPHA Fund in such matters and to provide and make available all information and personnel as may be reasonably required in the opinion of Administrator and General Counsel to fully investigate and defend the claim.
