In their Declarations, Defense Counsel and Defendant shall aver that they are not aware of any other pending matter or action asserting claims that will be extinguished or adversely affected by the Settlement.
Plaintiff will prepare and deliver to Defense Counsel at least 30 court days before the hearing date for the Motion for Preliminary Approval all documents necessary for obtaining Preliminary Approval, including: (i) a draft of the notice, and memorandum in support, of the Motion for Preliminary Approval that includes an analysis of the Settlement under Dunk/Xxxxxx and a request for approval of the PAGA Settlement under Labor Code Section 2699, subd.
Plaintiff shall provide drafts of these documents to Defense Counsel not later than seven days prior to filing the Motion for Final Approval.
Defendant shall fully fund the Gross Settlement Amount, and also fund the amounts necessary to fully pay Defendant’s share of payroll taxes, as calculated and communicated by Administrator to Defense Counsel, by transmitting the funds to the Administrator no later than 15 days after the Effective Date.
The Administrator shall promptly provide copies of all challenges to calculation of Workweeks and/or PAGA Pay Periods to Defense Counsel and Class Counsel and the Administrator’s determination the challenges.
