Investment protection standards Sample Clauses

Investment protection standards. In the early days of the discussion, a few scholars advanced the view that the new EU powers are limited to elements of market access. Given that the objective of the CCP under Article 206 TFEU is to strive for liberalisation, there would be no room to include post-establishment protections in the scope of Article 207 TFEU56. In our view, this position cannot be upheld. Neither the wording, nor its object and purpose justify such narrow reading57. According to ECJ jurisprudence, an act falls within the scope of the CCP ‘if it relates specifically to international trade in that it is essentially intended to promote, facilitate or govern trade and has direct and immediate effects on trade in the product concerned’58. For this reason, the EU was able to conclude the TBT (Technical Barriers to Trade) and the SPS (Sanitary or Phytosanitary Measures) Agreements in the WTO. While the case law and practice relates to trade in goods, it is equally persuasive for investment. In the same vein as health and safety standards may restrict trade in goods, certain regu- latory standards or decisions may impinge on investments. The Union’s compe- tence thus extends to all measures that are intended to promote, facilitate or govern foreign direct investment and has a direct and immediate effect on it. Investment protection standards evidently fulfil this test and are thus covered by Article 207(1)
