Irrevocable Establishment. The Settling Defendants hereby and irrevocably establish this Mitigation Trust on behalf of the Beneficiaries. The Trustee hereby accepts and agrees to hold the assets owned by the Mitigation Trust (“Trust Assets”) for the benefit of the Beneficiaries and for the purposes described herein and in the Consent Decree.
