Common use of Landlord’s Election Clause in Contracts

Landlord’s Election. In the event that the Complex or Building is destroyed to the extent of not less than thirty-three and one-third percent (33-1/3%) of the replacement cost thereof, Landlord may elect to terminate this Lease, whether the Leased Premises be injured or not, in the same manner as in Section 19.1 above. In all events, a total destruction of the Complex or Building shall terminate this Lease.

Landlord’s Election. In the event that the Complex or Building is destroyed to the extent of not less than thirtytwenty-three and one-third five percent (33-1/325%) of the replacement cost thereof, Landlord may elect to terminate this Lease, whether the Leased Premises be injured or not, in the same manner as in Section 19.1 above. In all events, a total destruction of the Complex or Building shall terminate this Lease.

In the event that If the Complex or Building is destroyed to the extent of not less by more than thirty-three and one-third 35 percent (33-1/3%) of the replacement cost thereofcost, Landlord may elect to terminate this Lease, whether the Leased Premises be injured are damaged or not, in the same manner as set forth in Section 19.1 above13.1. In all events, a A total destruction of the Complex or Building shall terminate terminates this Lease.

In the event that If the Complex or Building is destroyed to the extent of not less by more than thirty-three and one-third 50 percent (33-1/3%) of the replacement cost thereofcost, Landlord may elect to terminate this Lease, whether the Leased Premises be injured are damaged or not, in the same manner as set forth in Section 19.1 above. In all events, a total destruction of the Complex or Building shall terminate this Lease12.1.

In the event that the Complex or Building Project is destroyed to the extent of not less than thirty-three and one-third percent (33-1/333 ⅓ %) of the replacement cost thereof, Landlord may elect to terminate this Lease, whether the Leased Premises be injured or not, in the same manner as in Section 19.1 14.1 above. In all events, a total destruction of the Complex or Building Project shall terminate this Lease.

In all events, a A total destruction of the Complex Building of which the Premises forms a part, or Building the Premises itself, shall terminate this Lease.
