Legacy Preference. Notwithstanding any other provisions of this agreement and of any other applicable law, a son or daughter of a firefighter who passes the required written and physical examination for entrance to the fire service or a son or daughter of a firefighter who passes the required written and physical examination for appointment as a fire alarm operator shall have his or her name placed in the first position on the eligible list immediately below the names of disabled veterans, if: in the case of a firefighter, such firefighter while in the performance of his or her duties suffers a LODD.
