Legal Process Absence. A. If an employee is subpoenaed to appear as a witness in court or in an administrative hearing, he/she will suffer no loss of regular straight time compensation, provided the following conditions are met: (1) Immediately upon returning to work, the employee signs and files with the Treasurer, a statement showing the amount of compensation received, if any, as a result of such appearance; and (2) Before the end of the current pay period, the employee remits to the Treasurer the amounts of any witness fee or other compensation received, less payment made to the employee specifically for expenses incurred by reason of the subpoena; and (3) If the appearance does not take an entire workday, the employee works the remainder of the day. B. If an employee is summoned for jury duty, he/she will suffer no loss of regular straight time compensation, provided the following conditions are met: (1) Immediately upon returning to work, the employee signs and files with the Treasurer, a statement showing the amount of compensation received; and (2) The employee remits the compensation received to the Treasurer before the end of the current pay period. C. In the event of absence to attend a court or administrative hearing, in which the employee is a party, the employee may use personal or emergency leave.
