Common use of Level 2 Procedures Clause in Contracts

Level 2 Procedures. A grievance unresolved at Level 1 and appealed to Level 2 shall be submitted in writing to the appropriate supervisor within ten (10) days of the Level 1 reply or due date. Such statement of grievance shall set forth the nature of the grievance, the facts on which it is based, the provisions of the Agreement allegedly violated, and the remedy requested. The principal/program administrator, supervisor or designated representative shall give the Employer’s Level 2 answer in writing within ten (10) days following receipt of the written grievance. If the Level 1 informal procedures have not been followed, the principal shall have an additional five (5) days in which to schedule a review meeting before replying to the written grievance. Any grievance not appealed in writing to Level 3 by Union within five (5) days after receipt or due date of the Employer’s Level 2 reply, shall be considered waived.
