LIABILITY FOR DAMAGES AND COSTS. Resident will be responsible for payment of all damages and costs to the Leased Premises, other apartments, or any other portion of the Community for repair, replacement, or cleaning due to smoking or smoke related damage caused by Resident, Resident's guests, and all other persons affiliated with Resident. Resident acknowledges that any damages or costs Owner incurs related to repairs, replacement, and cleaning due to smoking or due to violation of the No-Smoking Policy are not considered normal wear and tear.

LIABILITY FOR DAMAGES AND COSTS. 32.1. If an owner or occupier of a Unit or the invitees of the owner or occupier of a Unit cause/s damage to the Common Property, the owner of the Unit concerned shall be liable to the Body Corporate for the damage caused and for the costs of repairs. 32.2. An owner is liable for and must pay to the Body Corporate all reasonable legal costs on an attorney and client scale and disbursements incurred by the Body Corporate in the collection of arrear contributions or any other arrear amounts due and owing by such member to the Body Corporate, or in enforcing compliance with the Management Rules, the Conduct Rules or the Act.

  • Liability for Damages 1. The Purchaser shall be liable for any damages sustained by the State arising from Purchaser’s breach of the terms of this Contract and the State may cause all or part of the performance bond to be forfeited to recover such damages. 2. In the event that a portion of the timber sale under this Contract is resold as a result of the Purchaser’s forfeiture and the stumpage rate pursuant to the resold contract is lower than the stumpage rate provided herein, the difference between the original rate and the new rate shall be considered damages and the Purchaser shall be liable to the State for those damages. The State may cause all or part of the Purchaser’s performance bond to be forfeited to recover such damages.
