Licensing and Assignment. Each Party may determine conditions on the licensing and assignment of trademarks, it being understood that the compulsory licensing of trademarks shall not be permitted and that the owner of a registered trademark shall have the right to assign the trademark with or without the transfer of the enterprise to which the trademark belongs.
Licensing and Assignment. The conditions on the licensing and assignment of trademarks may be determined by members. The compulsory licensing of trademarks are not permitted. The owner may have the right to assign the trademark with or without the transfer of trademark related business. Geographical Indications The major provisions related to geographical indications are as follow: • Geographical indications refer to indications which identify a good as originating in the territory of a member or a region or locality in that territory, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin. • Members shall provide legal means to prevent: - misleading the public as to the geographical origin of the good, - an act of unfair competition. • A member can refuse or invalidate the registration of a trademark which contains or consists of a geographical indication with respect to goods not originating in the indicated territory. Additional protection for geographical indications for wines and spirits The agreements contain provisions for additional protection for geographical indications for wines and spirits. There will be legal means to prevent use of a geographical indication identifying wines for wines not originating in the place indicated by the geographical indication. The registration of trademark for wines which consists of a geographical indications identifying wines or for spirits shall be refused or invalidated; if they are not having this origin. In order to facilitate the protection of geographical indications for wines, negotiations shall be carried out in the council for TRIPS, concerning the establishment of a multilateral system of notification and registration. A member country is not obliged to protect geographical indications which are not or cease to be protected or have fallen into disuse in the country of origin.
