Licensor’s Rights and Remedies. Licensee agrees that Licensor retains, and may exercise, all rights and remedies available to Licensor as a result of Licensee’s breach of this Agreement, misuse of the Trademarks, or any other use of the Trademarks by Licensee which is not expressly permitted by this Agreement.
Licensor’s Rights and Remedies. Licensee acknowledges and agrees that Licensor has, shall retain, and may exercise, both during the term of this Agreement and thereafter, all rights and remedies available to Licensor, whether derived from this Agreement, from statute, or otherwise, as a result of or in connection with Licensee's breach of this Agreement, misuse of the Trademark, or any other use of the Trademark, the Intellectual Property or the Program by Licensee which is not expressly permitted by this Agreement. Licensee understands and expressly agrees that augmentations or improvements, if any, by Licensee, are subject to Licensor’s consent and approval, and shall not ever inure to the benefit of Licensee nor give Licensee any ownership rights in Licensor’s Intellectual Property and/or the Program, and hereby are confirmed as being the sole property of Licensor and Licensee retains no ownership or proprietary rights therein.
Licensor’s Rights and Remedies. Licensee understands, acknowledges and agrees that Licensor has, shall retain, and may exercise, both during the Term of this Agreement and thereafter, all rights and remedies available to Licensor, whether derived from this Agreement, from statute, common law, or otherwise, as a result of or in connection with Licensee's breach of this Agreement, misuse of the Intellectual Property, or any other use of the Intellectual Property by Licensee which is not expressly permitted by this Agreement, or as otherwise expressly permitted by Licensor in writing.
Licensor’s Rights and Remedies. In the event of Licensee’s default hereunder, then in addition to any other rights or remedies Licensor may have under the law, subject to the notice and cure provisions of Section 12. 1 Licensor shall have the right, at Licensor’s option to do the following:
(a) Upon thirty (30) calendar days’ notice (which notice period is in addition to and cumulative with any notice and cure periods set forth in Section 12. l), terminate this Agreement and Licensee's right to possess or use all part of the Arena occupied and used by Licensee and reenter the same and take possession thereof, and Licensee shall have no further claim to occupy or use the Arena under this Agreement.
(b) Continue this Agreement in effect, reenter and occupy any or all parts of the Arena for the account of Licensee, and collect any unpaid payments or other charges which have or thereafter become due and payable; or
Licensor’s Rights and Remedies. In the event of a breach of this Agreement by Licensee, other than an uncured breach of Section 2.2, in addition to the right to terminate this Agreement, Licensor shall be entitled to seek monetary damages from Licensee and, further, Licensor shall have all other rights and remedies available at law or in equity, including without limitation, the right to seek injunctive relief without any requirement for the posting of bond.
Licensor’s Rights and Remedies. Licensee acknowledges and agrees that Licensor has, shall retain, and may exercise, both during the term of this Agreement and thereafter, all rights and remedies available to Licensor, whether derived from this Agreement, from statute, or otherwise, as a result of or in connection with Licensee's breach of this Agreement, misuse of the Bikram IP, or any other use of the Bikram IP by Licensee which is not expressly permitted by this Agreement.
