Limitation of Funds. This effort may be incrementally funded. Not all funds are presently available for this agreement. Funds are not presently available for performance under this agreement beyond the funding amount shown on Page 2 of this agreement and the funded milestone under attachment 1. The Government’s obligation for performance of this agreement beyond that milestone is contingent upon the availability of appropriated funds from which payment for agreement purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this agreement beyond the funding listed under page 2 of the agreement, and until funds are made available to the Agreements Officer for performance and the PERFORMER receives notice of availability in writing by the Agreements Officer.
