Common use of Limitation on Paid Overtime Clause in Contracts

Limitation on Paid Overtime. 1. As provided for in the above, time off in lieu of overtime pay may be requested at the option of the employee and granted at the Chief's discretion and shall be given on the basis of time and one-half for actual hours worked. No employees shall be paid for overtime in excess of one hundred thirty (130) hours in any calendar year. Overtime accruing to any employee in excess of one hundred thirty (130) hours in any calendar year shall be compensated for by giving the employee equivalent time off at that employee's straight hourly rate, namely hour for hour.
