Liquidated Damages. Xxxxxxx agrees that noncompliance with the requirements specified in the Contract causes damages to System Agency that are difficult to ascertain and quantify. Xxxxxxx further agrees that System Agency may impose liquidated damages each month for so long as the noncompliance continues. Failure to comply with any of the Contract requirements, System Agency may impose liquidated damages of: 1. $500 for the first occurrence of noncompliance during a fiscal year; 2. $750 for the second occurrence of noncompliance with the same requirement during the same fiscal year; and 3. $1,000 for the third and subsequent occurrence(s) of noncompliance with the same requirement during the same fiscal year.
