Common use of Long Term Absences Clause in Contracts

Long Term Absences. If an employee is absent on Long-term Disability or for any other reason for a period of more than two (2) years, the Employer and the Union may mutually agree to post the job as a permanent vacancy. However, should the affected employee return from his/her absence, he/she will be placed on the job she was on immediately prior to his/her absence, or another job which will be mutually agreed to by the Employer and the Union. It is recognized that displacements will occur as a result of the affected employee returning to work. This may include a layoff. Therefore, the bumping process will be implemented. When the job of the affected employee is posted permanently, the following clause will appear on the job posting: “This job is being filled to replace an absent employee. Should this employee return, it could result in the displacement of the current incumbent or another employee.”
