Common use of Loss of Use Coverage Clause in Contracts

Loss of Use Coverage. (a) Subject to subsections (b) to (e), loss of use coverage under this section applies only to the motor vehicle described in the owner’s certificate and is in accordance with the coverage provided under section 5.14. (b) Reimbursement provided under this section is excess to the coverage provided under section 7.8 but is primary to any coverage provided under section 5.13, 5.14 or 7.4. (c) For the purposes of this section, the loss of use coverage under section 5.14 has a daily limit of $100 for all vehicles other than motor homes and shall not exceed a total limit of (i) $1,000 in the case of a motor home, and (ii) $750 in all other cases.

Loss of Use Coverage. (b) Reimbursement provided under this section is excess to the primary coverage provided under section 7.8 but is primary to and any coverage reimbursement provided under section 5.13, 5.14 or 7.46.4 is excess to the coverage provided under this section. (c) For the purposes of this section, the loss of use coverage under section 5.14 has a daily limit of $100 for all vehicles other than motor homes and shall not exceed a total limit of (i) $1,000 in the case of a motor home, and (ii) $750 500 in all other cases. (d) The definitions in section 5.1 apply to this section. (e) Coverage provided under this section does not apply in respect of a temporary substitute motor vehicle defined in section 5.6.
