Common use of Maintenance of the System Clause in Contracts

Maintenance of the System. The Borrower shall maintain its System, including the Project, in good condition and repair and make all necessary renewals, replacements, additions, betterments and improvements thereto. The Borrower shall not grant or permit to exist any lien on the System or the Project other than liens securing System Debt where a parity or superior lien secures this Loan Agreement and the Borrower Bond, provided that this Section shall not be deemed violated if a mechanic’s or contractor’s lien is filed against the property, as long as the Borrower uses its best efforts to obtain the discharge of such lien, and promptly reports the filing of such lien, the proposed steps to discharge the lien, and the discharge of the lien to the District.
