Manner of Use. (a) To effect a purchase using the Credit Card from any Authorised Merchant, the Cardmember must sign on a Sales Draft prepared by the Authorised Merchant with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of the purchase transaction; (b) To effect a cash withdrawal using the Credit Card from any Authorised Cash Outlet, the Cardmember shall sign on a Cash Withdrawal Draft prepared by the Authorised Cash Outlet with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of any Cash Withdrawal transaction; (c) To effect a cash withdrawal through ATM, the Cardmember shall use the Personal Identification Number (PIN) to gain access to his/her Credit Card Account (a) Maybank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet all Sales Drafts and Cash Withdrawal Drafts incurred through the use of the Credit Card and is hereby expressly authorised to debit the Cardmember’s Credit Card Account accordingly. (b) Notwithstanding the provisions set out in Clause 4.1 above, the Cardmember hereby expressly authorises Maybank to charge his/her Credit Card Account with any payments made to the Authorised Merchant or Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts which had not been signed by the Cardmember, if Maybank is of the view, upon satisfactory documentary evidence, that the omission is due to an oversight on the part of the Cardmember and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the Cardmember 4.3. 4.3. 4.3 The Cardmember Cardholder shall comply with all requirements, directions, instructions and guidelines for use of the Credit Card issued by Maybank from time to time in respect of all credit, credit and banking facilities and And services rendered to the Cardmembercardholder.
4.4. (a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember Cardholder to be debited to the account of the CardmemberCardholder;
(b) The Cardholder agrees that the record of Maybank of any transaction effected by the use of the Credit Card shall be conclusive and binding on the Cardholder for all purposes; and
(c) The Cardholder shall be liable for all charges and advances whatsoever arising from all transactions, whether authorised or unauthorised, effected with the Credit Card.
4.5 Notwithstanding Clause 4.1 above, a purchase may also be effected by providing the Authorised Merchant the Credit Card Number together with such other particulars as may be recorded on the Credit Card and without the requirement of the Cardholder's signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sales Terminals including but not limited transactions at petrol kiosks and/or through such other modes that may be introduced/implemented from time to time.
4.6 Where the Cardholder uses the Credit Card for the purpose of betting, including lottery tickets, casino gaming chips, off-track betting, xxxxxx at race tracks, the transactions shall be considered as a Cash Withdrawal and the relevant Cash Withdrawal Fee shall be in imposed by the Bank.
4.7 Notwithstanding any provisions to the contrary herein set out, Maybank may at its sole and absolute discretion at any point of time or without notice decide not to renew, cancel, revoke the Credit Card or suspend or restrict the use of Credit Card by the Cardholder and/or any Supplementary Credit card without assigning any reason thereof upon the occurrence of any one of the following events :
a) Use the Credit Card/Supplementary Credit Card as payment for any illegal purchases; or
b) Use the Credit Card/Supplementary Credit Card as payment for any unlawful transaction; or
c) Use the Credit Card/Supplementary Credit Card to engage in an Internet gambling transaction; or
d) Use the Credit Card/Supplementary Credit Card to purchase goods or services that will be resold i.e. “not for personal use of the Cardholder/Supplementary Credit Cardholder”.

4.6 Notwithstanding any other Terms and Conditions to the contrary herein set out, the Bank may at its sole and absolute discretion at any point of time with immediate notice decide not to renew, cancel, revoke the card or suspend or restrict the use of card by the Cardmember and/or any supplementary card upon the occurrence of any one of the following events:
(a) Use the Card as payment for any illegal/unlawful purchases made by the Cardmember; or
(b) Use the Card to engage in an Internet gambling transaction done by the Cardmember; or
(c) Use the Card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember”; or
(d) Use the Card as payment for non-Shariah approved transaction.
4.7 Without prejudice to Clause 4.6 herein, if the Cardmember uses the Card for purposes prohibited by the Shariah or for the purchase of non-halal or non Shariah-approved goods or services at businesses or premises, such Cardmember shall nevertheless be fully liable to pay the Bank the amount due in respect of such uses or purchases in accordance with this Agreement and the Cardmember hereby expressly agrees and undertakes that he will not plead such usage as a defence to claim for payment of the amounts due to the Bank or otherwise rely on it to refuse payment of amounts due.

Manner of Use. (a) To effect a 4.1 A credit purchase using the Credit Card from any Authorised Merchant, Merchant using VISA/MASTERCARD CARD generally requires the Cardmember must Cardholder to sign on a Sales Draft prepared by the Authorised Merchant with or by entering a PIN, unless the use purchase of goods and/or services are made or incurred through mail or telephone orders, POS Terminals, Contactless Terminal, the internet or any similar means;
4.2 The Cardholder authorises the Bank to debit the VISA/MASTERCARD CARD Account for all Retail Transactions made or incurred using the VISA/MASTERCARD CARD in the manner described in this Clause 4. Failure on the part of the Credit Card, but Cardholder to sign any Sales Drafts or enter a PIN will not relieve the signature shall not be a condition precedent Cardholder from liability to the liability Bank in respect thereof, if the Bank is of the Cardmember in respect opinion that the omission is due to the nature of the purchase transactiontransaction or due to an oversight on the part of the Cardholder and/or the Authorised Merchant;
(b) 4.3 To effect a cash withdrawal Cash Advance using the Credit Card VISA/MASTERCARD CARD from any the Authorised Cash Outlet, the Cardmember shall Cardholder must sign on a Cash Withdrawal Advance Draft prepared by the Authorised Cash Outlet or by entering a PIN with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of any Cash Withdrawal transactionVISA/ MASTERCARD CARD;
(c) 4.4 To effect a cash withdrawal Cash Advance through the ATM, the Cardmember Cardholder shall use the Personal Identification Number (PIN) PIN to gain access to hishis VISA/her Credit Card MASTERCARD CARD Account;
(a) Maybank 4.5 Where the Cardholder uses the VISA/MASTERCARD CARD for the purpose of gaming related transaction which include but not limited to the purchase of or in exchange for casino chips, lottery tickets, betting slips, off-track betting and xxxxxx at race tickets or of whatsoever nature, such transactions shall be considered as Cash Advance and the relevant Cash Advance fees as provided in Clause 11.4 shall be imposed by the Bank;
4.6 The Bank however, reserves the right to immediately terminate the credit card facility if the Cardholder is found to have used the VISA/MASTERCARD CARD for any unlawful activities such as illegal online betting or payment for any illegal purchases;
4.7 In consideration of the Cardholder observing and complying with the terms of this Agreement, the Bank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet Outlets or through any member institution of Visa International or MasterCard International all Sales Drafts and Cash Withdrawal Advance Drafts incurred through by the use of the Credit Card Cardholder and is hereby expressly authorised to debit the CardmemberCardholder’s Credit Card VISA/MASTERCARD CARD Account accordingly.;
(b) 4.8 Notwithstanding the provisions provision set out in Clause Clauses 4.1 and/or 4.3 above, the Cardmember Cardholder hereby expressly authorises Maybank the Bank to charge hishis VISA/her Credit Card MASTERCARD CARD Account with any payments made to the Authorised Merchant or and/or to Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts Advance Drafts. The Bank shall not hold a Cardholder liable for card-present unauthorized transactions which had not been signed by require PIN verification, signature verification or the Cardmember, if Maybank is use of contactless card unless the Bank can prove that the Cardholder has:
48.1 acted fraudulently;
48.2 delayed in notifying after having discovered the loss or unauthorized used of the view, upon satisfactory documentary evidence, that card;
48.3 voluntarily disclosed the omission is due PIN to an oversight another person or allowed others to use the credit card;
48.4 recorded PIN on the part credit card or within close proximity;
48.5 left the credit card unattended and assessable to others.
4.9 Pre-authorisation amount of the Cardmember and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the Cardmember
4.3Ringgit Malaysia Two Hundred (RM200) is required for self-service pumps. The Cardmember pre-authorisation amount is a temporary hold from the Cardholder’s available credit limit in the VISA/MASTERCARD CARD Account before Petrol is filled. The pre-authorisation amount will be cleared within three (3) Calendar Days and the actual amount for petrol transaction will be debited from your VISA/MASTERCARD CARD Account;
4.10 The Cardholder shall comply with all requirements, directions, instructions and guidelines for in connection with the use of the Credit Card VISA/MASTERCARD CARD issued by Maybank the Bank from time to time in respect of all credit, banking VISA/ MASTERCARD CARD facilities and services rendered to the CardmemberCardholder.
4.4. a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember;

Notwithstanding Clause 4.1 above, a purchase may also be effected by providing the Authorised Merchant the Credit Card Number together with such other particulars as may be recorded on the Credit Card and without the requirement of the Cardmember’s signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sale Terminals including but not limited to transactions at petrol kiosks and/or through such other modes that may be introduced/implemented by Maybank as and when Maybank may in its absolute discretion from time to time.
4.6. Where the Cardmember uses the Credit Card for the purpose of betting, including lottery tickets, casino gaming chips, off-track betting, xxxxxx at race tracks, the transaction shall be considered as a Cash Withdrawal and the relevant Cash Withdrawal Fee shall be imposed by the Bank.
4.7. Notwithstanding any other provisions to the contrary herein set out, Maybank may at its sole and absolute discretion at any point of time with or without notice can decide not to renew, cancel, revoke the Credit Card or suspend or restrict the use of Credit Card by the Cardmember and/or any supplementary Credit Card upon the occurrence of any one of the following events:
a. Use the Credit Card as payment for any illegal purchases; or
b. Use the Credit Card as payment for any unlawful transaction; or
c. Use the Credit Card to purchase goods and services that will be resold i.e. “not for personal use of the Cardmember”.

Manner of Use. (b) Notwithstanding the provisions Terms and Conditions set out in Clause 4.1 above, the Cardmember hereby expressly authorises Maybank the Bank to charge his/his / her Credit Card Account with any payments made to the Authorised Merchant or Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts which had not been signed by the Cardmember, if Maybank the Bank is of the view, upon satisfactory documentary evidence, that the omission is due to an oversight on the part of the Cardmember and/or and / or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the Cardmember.
4.3. 4.3 The Cardmember shall comply with all requirements, directions, instructions and guidelines for use of the Credit Card issued by Maybank the Bank from time to time in respect of all credit, credit and banking facilities and services rendered to the Cardmember.
4.4. (a) Maybank The Bank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember;
(b) The Cardmember agrees that the record of the Bank of any transaction effected by the use of the Card shall be conclusive and binding on the Cardmember for all purposes; and
(c) The Cardmember shall be liable for all charges and Cash Withdrawals whatsoever arising from all transactions, whether authorised or unauthorised, effected with the Card.
4.5 Notwithstanding Clause 4.1 above, a purchase may also be effected by providing the Authorised Merchant the Card Number together with such other particulars as may be recorded on the Card and without the requirement of the Cardmember’s signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sales Terminals including but not limited to transactions at petrol kiosks and / or through such other modes that may be introduced / implemented from time to time.
4.6 Notwithstanding any other Terms and Conditions to the contrary herein set out, the Bank may at its sole and absolute discretion at any point of time with immediate notice decide not to renew, cancel, revoke the card or suspend or restrict the use of card by the Cardmember and / or any supplementary card upon the occurrence of any one of the following events:-
(i) Use the card as payment for any illegal / unlawful purchases made by the Cardmember; or
(ii) Use the card to engage in an Internet gambling transaction done by the Cardmember; or
(iii) Use the card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember”; or
(iv) Use the card as payment for non-Shariah approved transaction.
4.7 Without prejudice to Clause 4.6 herein, if the Cardmember uses the Card for purposes prohibited by the Shariah or for the purchase of non-halal or non Shariah-approved goods or services at businesses or premises, such Cardmember shall nevertheless be fully liable to pay the Bank the amount due in respect of such uses or purchases in accordance with this Agreement and the Cardmember hereby expressly agrees and undertakes that he will not plead such usage as a defence to claim for payment of the amounts due to the Bank or otherwise rely on it to refuse payment of amounts due.

Manner of Use. (a) To effect a purchase using the Credit Card from any Authorised Merchant, the Cardmember must enter pin or sign on a Sales Draft on non-chip and Personal Identification Number (PIN) environment prepared by the Authorised Merchant with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of the purchase transaction;
(b) To effect a cash withdrawal purchase through contactless transaction, the card must be very close to the contactless reader (within 4cm distance between the card and reader) to tap or wave. The Card member able to perform contactless transaction by themselves and will be prompted to key in PIN for transactions above RM250.00. Transactions below RM250.00 made using contactless environment do not require PIN.
(c) To effect a Cash Withdrawal using the Credit Card from any Authorised Cash Outlet, the Cardmember shall must enter pin or sign on a Cash Withdrawal Draft prepared by the Authorised Cash Outlet with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of any the Cash Withdrawal transaction;
(cd) To effect a cash withdrawal Cash Withdrawal through ATM, the Cardmember shall use the Personal Identification Number (PIN) PIN to gain access to his/her Credit Card Account.

4.6 Notwithstanding any other Terms and Conditions to the contrary herein set out, the Bank may at its sole and discretion at any point of time with immediate notice decide not to renew, cancel, revoke the card or suspend or restrict the use of card by the Cardmember and/or any supplementary card upon the occurrence of any one of the following events:
(i) Use the card as payment for any illegal/unlawful purchases made by the Cardmember; or
(ii) Use the Credit Card as payment for any unlawful transaction such as illegal online betting done by the Cardmember; or
(iii) Use the card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember”; or
(iv) Use the card as payment for non-Shariah approved transaction.

(c) The Cardholder shall be liable for all charges and advances whatsoever arising from all transactions, whether authorised or unauthorised, effected with the Credit Card.
(d) The Principal Cardholder is entitled to earn TreatsPoints on retail purchases made with his/her PETRONAS Maybankard Visa for purposes of personal consumption only, i.e. non-business and non-commercial related consumption only. Maybank reserves the right not to award TreatsPoints on retail spend which Maybank deems to be purchases made for business and commercial purposes using the Maybankard.
3.5 Notwithstanding Clause 3.1 above, a purchase may also be effected by providing the Authorised Merchant the Credit Card Number together with such other particulars as may be recorded on the Credit Card and without the requirement of the Cardholder's signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sales Terminals including but not limited transactions at petrol kiosks and/or through such other modes that may be introduced/implemented from time to time.

b) Use the Credit Card/Supplementary Credit Card as payment for any unlawful transaction; or
c) Use the Credit Card/Supplementary Credit Card to engage in an Internet gambling transaction; or
d) Use the Credit Card/Supplementary Credit Card to purchase goods or services that will be resold i.e not for personal use of the Cardholder/Supplementary Credit Cardholder.

(b) To effect a cash withdrawal Cash Withdrawal using the Credit Card from any Authorised Cash Outlet, the Cardmember shall sign on a Cash Withdrawal Draft prepared by the Authorised Cash Outlet with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of any the Cash Withdrawal transaction;
(c) To effect a cash withdrawal Cash Withdrawal through ATM, the Cardmember shall use the Personal Identification Number (PIN) to gain access to his/her Credit Card Account.
(a) Maybank The Bank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet all Sales Drafts and Cash Withdrawal Drafts incurred through the use of the Credit Card and is hereby expressly authorised to debit the Cardmember’s Credit Card Account accordingly.
(b) Notwithstanding the provisions Terms and Conditions set out in Clause 4.1 above, the Cardmember hereby expressly authorises Maybank the Bank to charge his/her Credit Card Account with any payments made to the Authorised Merchant or Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts which had not been signed by the Cardmember, if Maybank the Bank is of the view, upon satisfactory documentary evidence, that the omission is due to an oversight on the part of the Cardmember and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the Cardmember.
4.3. 4.3 The Cardmember shall comply with all requirements, directions, instructions and guidelines for use of the Credit Card issued by Maybank the Bank from time to time in respect of all credit, credit and banking facilities and services rendered to the Cardmember.
4.4. (a) Maybank The Bank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember;
(b) The Cardmember agrees that the record of the Bank of any transaction effected by the use of the Card shall be conclusive and binding on the Cardmember for all purposes; and
(c) The Cardmember shall be liable for all charges and Cash Withdrawals whatsoever arising from all transactions, whether authorised or unauthorised, effected with the Card.
4.5 Notwithstanding Clause 4.1 above, a purchase may also be effected by providing the Authorised Merchant the Card Number together with such other particulars as may be recorded on the Card and without the requirement of the Cardmember’s signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sales Terminals including but not limited to transactions at petrol kiosks and/or through such other modes that may be introduced/implemented from time to time.
4.6 Notwithstanding any other Terms and Conditions to the contrary herein set out, the Bank may at its sole and absolute discretion at any point of time with immediate notice decide not to renew, cancel, revoke the card or suspend or restrict the use of card by the Cardmember and/or any supplementary card upon the occurrence of any one of the following events:
(i) Use the card as payment for any illegal/unlawful purchases made by the Cardmember; or
(ii) Use the Credit Card as payment for any unlawful transaction such as illegal online betting done by the Cardmember; or
(iii) Use the card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember”; or
(iv) Use the card as payment for non-Shariah approved transaction.
4.7 Without prejudice to Clause 4.6 herein, if the Cardmember uses the Card for purposes prohibited by the Shariah or for the purchase of non-halal or non Shariah-approved goods or services at businesses or premises, such Cardmember shall nevertheless be fully liable to pay the Bank the amount due in respect of such uses or purchases in accordance with this Agreement and the Cardmember hereby expressly agrees and undertakes that he will not plead such usage as a defence to claim for payment of the amounts due to the Bank or otherwise rely on it to refuse payment of amounts due.

Manner of Use. d) Use the Credit Card/Supplementary Credit Card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember/Supplementary Credit Cardmember”.

(b) To effect a cash withdrawal using the Credit Card from any Authorised Cash Outlet, the Cardmember Cardholder shall sign on a Cash Withdrawal Draft prepared by the Authorised Cash Outlet with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember Cardholder in respect of any the Cash Withdrawal transaction;
(c) To effect a cash withdrawal through ATM, the Cardmember Cardholder shall use the Personal Identification Number (PIN) to gain access to his/her Credit Card Account.
(a) Maybank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet all Sales Drafts and Cash Withdrawal Drafts incurred through the use of the Credit Card and is hereby expressly authorised to debit the Cardmember’s Cardholder's Credit Card Account accordingly.
(b) Notwithstanding the provisions provision set out in Clause 4.1 3.1 above, the Cardmember Cardholder hereby expressly authorises Maybank to charge his/her Credit Card Account account with any payments made to the Authorised Merchant or Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts which had not been signed by the CardmemberCardholder, if Maybank is of the view, upon satisfactory documentary evidence, that the omission is due to an oversight on the part of the Cardmember Cardholder and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the CardmemberCardholder.
4.3. 3.3 The Cardmember Cardholder shall comply with all requirements, directions, instructions and guidelines for use of the Credit Card issued by Maybank from time to time in respect of all credit, credit and banking facilities and And services rendered to the CardmemberCardholder.
4.4. (a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember Cardholder to be debited to the account of the CardmemberCardholder;
(b) The Cardholder agrees that the record of Maybank of any transaction effected by the use of the Credit Card shall be conclusive and binding on the Cardholder for all purposes; and
(c) The Cardholder shall be liable for all charges and advances whatsoever arising from all transactions, whether authorised or unauthorised, effected with the Credit Card.
(d) The Principal Cardholder is entitled to earn TreatsPoints on retail purchases made with his/her Maybankard for purposes of personal consumption only, i.e. non-business and non- commercial related consumption only. Maybank reserves the right not to award TreatsPoints on retail spend which Maybank deems to be purchases made for business and commercial purposes using the Maybankard.
3.5 Notwithstanding Clause 3.1 above, a purchase may also be effected by providing the Authorised Merchant the Credit Card Number together with such other particulars as may be recorded on the Credit Card and without the requirement of the Cardholder's signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sales Terminals including but not limited transactions at petrol kiosks and/or through such other modes that may be introduced/implemented from time to time.
3.6 Where the Cardholder uses the Credit Card for the purpose of betting, including lottery tickets, casino gaming chips, off-track betting, xxxxxx at race tracks, the transactions shall be considered as a Cash Withdrawal and the relevant Cash Withdrawal Fee shall be in imposed by the Bank.
3.7 Notwithstanding any provisions to the contrary herein set out, Maybank may at its sole and absolute discretion at any point of time or without notice can decide not to renew, cancel, revoke the Credit Card or suspend or restrict the use of Credit Card by the Cardholder and/or any Supplementary Credit card without assigning any reason thereof upon the occurrence of any one of the following events :
a) Use the Credit Card/Supplementary Credit Card as payment for any illegal purchases; or
b) Use the Credit Card/Supplementary Credit Card as payment for any unlawful transaction; or
c) Use the Credit Card/Supplementary Credit Card to engage in an Internet gambling transaction; or
d) Use the Credit Card/Supplementary Credit Card to purchase goods or services that will be resold i.e not for personal use of the Cardholder/Supplementary Credit Cardholder.

(a) Use the Card as payment for any illegal/unlawful purchases made by the Cardmember; or
(b) Use the Card to engage in an Internet gambling transaction done by the Cardmember; or
(c) Use the Card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember”; or
(d) Use the Card as payment for non-Shariah approved transaction.
4.7 Without prejudice to Clause 4.6 herein, if the Cardmember uses the Card for purposes prohibited by the Shariah or for the purchase of non-halal or non Shariah-approved goods or services at businesses or premises, such Cardmember shall nevertheless be fully liable to pay the Bank the amount due in respect of such uses or purchases in accordance with this Agreement and the Cardmember hereby expressly agrees and undertakes that he will not plead such usage as a defence to claim for payment of the amounts due to the Bank or otherwise rely on it to refuse payment of amounts due.

Manner of Use. (a) To effect a 4.1 A credit purchase using the Credit Card from any Authorised Merchant, Merchant using VISA/MASTERCARD CARD generally requires the Cardmember must Cardholder to sign on a Sales Draft prepared by the Authorised Merchant with or by entering a PIN, unless the use purchase of goods and/or services are made or incurred through mail or telephone orders, POS Terminals, Contactless Terminal, the internet or any similar means;
4.2 The Cardholder authorises the Bank to debit the VISA/MASTERCARD CARD Account for all Retail Transactions made or incurred using the VISA/MASTERCARD CARD in the manner described in this Clause 4. Failure on the part of the Credit Card, but Cardholder to sign any Sales Drafts or enter a PIN will not relieve the signature shall not be a condition precedent Cardholder from liability to the liability Bank in respect thereof, if the Bank is of the Cardmember in respect opinion that the omission is due to the nature of the purchase transactiontransaction or due to an oversight on the part of the Cardholder and/or the Authorised Merchant;
(b) 4.3 To effect a cash withdrawal Cash Advance using the Credit Card VISA/MASTERCARD CARD from any the Authorised Cash Outlet, the Cardmember shall Cardholder must sign on a Cash Withdrawal Advance Draft prepared by the Authorised Cash Outlet or by entering a PIN with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of any Cash Withdrawal transactionVISA/ MASTERCARD CARD;
(c) 4.4 To effect a cash withdrawal Cash Advance through the ATM, the Cardmember Cardholder shall use the Personal Identification Number (PIN) PIN to gain access to hishis VISA/her Credit Card MASTERCARD CARD Account;
(a) Maybank 4.5 Where the Cardholder uses the VISA/MASTERCARD CARD for the purpose of gaming related transaction which include but not limited to the purchase of or in exchange for casino chips, lottery tickets, betting slips, off-track betting and xxxxxx at race tickets or of whatsoever nature, such transactions shall be considered as Cash Advance and the relevant Cash Advance fees as provided in Clause 10.5 shall be imposed by the Bank;
4.6 The Bank however, reserves the right to immediately terminate the credit card facility if the Cardholder is found to have used the VISA/MASTERCARD CARD for any unlawful activities such as illegal online betting or payment for any illegal purchases;
4.7 In consideration of the Cardholder observing and complying with the terms of this Agreement, the Bank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet Outlets or through any member institution of Visa International or MasterCard International all Sales Drafts and Cash Withdrawal Advance Drafts incurred through by the use of the Credit Card Cardholder and is hereby expressly authorised to debit the CardmemberCardholder’s Credit Card VISA/MASTERCARD CARD Account accordingly.;
(b) 4.8 Notwithstanding the provisions provision set out in Clause Clauses 4.1 and/or 4.3 above, the Cardmember Cardholder hereby expressly authorises Maybank the Bank to charge hishis VISA/her Credit Card MASTERCARD CARD Account with any payments made to the Authorised Merchant or and/or to Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Advance Drafts which had has not been signed by the CardmemberCardholder, if Maybank the Bank is of the view, upon satisfactory documentary evidence, that the omission is due to an oversight on the part of the Cardmember Cardholder and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the CardmemberCardholder;
4.34.9 Pre-authorisation amount of Ringgit Malaysia Two Hundred (RM200) is required for self-service pumps. The Cardmember pre-authorisation amount is a temporary hold from the Cardholder’s available credit limit in the VISA/MASTERCARD CARD Account before Petrol is filled. The pre-authorisation amount will be cleared within three (3) Calendar Days and the actual amount for petrol transaction will be debited from your VISA/MASTERCARD CARD Account;
4.10 The Cardholder shall comply with all requirements, directions, instructions and guidelines for in connection with the use of the Credit Card VISA/MASTERCARD CARD issued by Maybank the Bank from time to time in respect of all credit, banking VISA/ MASTERCARD CARD facilities and services rendered to the CardmemberCardholder.
4.4. a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember;

(b) Notwithstanding for all purchases and/or services made or incurred using the provisions set out in Clause 4.1 above, the Cardmember hereby expressly authorises Maybank to charge hisVISA/her MASTERCARD Business Credit Card Account with in the manner described in this Clause 5. Failure on the part of the Cardholder to sign any payments made to the Authorised Merchant or Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts which had enter a PIN will not been signed by relieve the CardmemberMember from liability to the Bank in respect thereof, if Maybank the Bank is of the view, upon satisfactory documentary evidence, opinion that the omission is due to the nature of the transaction or due to an oversight on the part of the Cardmember Cardholder and/or the Authorised Merchant.
5.3 To effect a Cash Advance through the ATM, the Cardholder shall use the PIN to gain access to his VISA/MASTERCARD Business Credit Card Account.
5.4 The Bank however, reserves the right to immediately terminate the Credit Card facility if the Cardholder is found to have used the VISA/MASTERCARD Business Credit Card for any unlawful activities such as illegal online betting or payment for any illegal purchases.
5.5 In consideration of the Cardholder observing and complying with the terms of this Agreement, the Bank shall purchase from the Authorised Merchant or Authorised through any member institution of Visa International or Mastercard International all Sales Drafts and Cash Outlet or if Withdrawal Drafts incurred by the Authorised Merchant has undercharged Cardholder and debit the CardmemberCardholder’s VISA/MASTERCARD Business Credit Card Account accordingly.
4.3. 5.6 The Cardmember Cardholder shall comply with all requirements, directions, instructions and guidelines for in connection with the use of the VISA/MASTERCARD Business Credit Card issued by Maybank the Bank from time to time in respect of all credit, banking VISA/MASTERCARD Business Credit Card facilities and services rendered to the CardmemberCardholder.
4.4. a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember;

Manner of Use. (a) Maybank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet all Sales Drafts and Cash Withdrawal Drafts incurred through the use of the Credit Card and is hereby expressly authorised to debit the CardmemberCardholder’s Credit Card Account accordingly.
(b) Notwithstanding Not withstanding the provisions provision set out in Clause 4.1 3.1 above, the Cardmember Cardholder hereby expressly authorises Maybank to charge his/her Credit Card Account with any payments made to the Authorised Merchant or Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts which had not been signed by the CardmemberCardholder, if Maybank is of the view, upon satisfactory documentary evidence, that the omission is due to an oversight on the part of the Cardmember Cardholder and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the CardmemberCardholder.
4.3. 3.3 The Cardmember Cardholder shall comply with all requirements, directions, instructions and guidelines for use of the Credit Card issued by Maybank from time to time in respect of all credit, credit and banking facilities and services rendered to the CardmemberCardholder.
4.4. (a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember Cardholder to be debited to the account of the CardmemberCardholder;
(b) The Cardholder agrees that the record of Maybank of any transaction effected by the use of the Credit Card shall be conclusive and binding on the Cardholder for all purposes; and
(c) The Cardholder shall be liable for all charges and advances whatsoever arising from all transactions, whether authorised or unauthorised, effected with the Credit Card.
3.5 Not withstanding Clause 3.1 above, a purchase may also be effected by providing the Authorised Merchant the Credit Card Number together with such other particulars as may be recorded on the Credit Card and without the requirement of the Cardholder’s signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sales Terminals including but not limited to transactions at petrol kiosks and/or through such other modes that may be introduced/ implemented from time to time.
3.6 Where the Cardholder uses the Credit Card for the purpose of betting, including lottery tickets, casino gaming chips, off-track betting, xxxxxx at race tracks, the transactions shall be considered as a Cash Withdrawal and the relevant Cash Withdrawal Fee shall be imposed by the Bank.
3.7 Notwithstanding anything contained in this Agreement the cardholder shall not:-
(a) use the Credit Card as payment for any illegal purchases.
(b) use the Credit Card to engage in an Internet gambling transaction.

Manner of Use. (a) Maybank 4.5 Where the Cardholder uses the VISA/MASTERCARD CARD for the purpose of gaming related transaction which include but not limited to the purchase of or in exchange for casino chips, lottery tickets, betting slips, off-track betting and xxxxxx at race tickets or of whatsoever nature, such transactions shall be considered as Cash Advance and the relevant Cash Advance fees as provided in Clause 10.5 shall be imposed by the Bank;
4.6 The Bank however, reserves the right to immediately terminate the credit card facility if the Cardholder is found to have used the VISA/MASTERCARD CARD for any unlawful activities such as illegal online betting or payment for any illegal purchases;
4.7 In consideration of the Cardholder observing and complying with the terms of this Agreement, the Bank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet Outlets or through any member institution of Visa International or MasterCard International all Sales Drafts and Cash Withdrawal Advance Drafts incurred through by the use of the Credit Card Cardholder and is hereby expressly authorised to debit the Cardmember’s Credit Card Cardholder‟s VISA/MASTERCARD CARD Account accordingly.;
(b) 4.8 Notwithstanding the provisions provision set out in Clause Clauses 4.1 and/or 4.3 above, the Cardmember Cardholder hereby expressly authorises Maybank the Bank to charge hishis VISA/her Credit Card MASTERCARD CARD Account with any payments made to the Authorised Merchant or and/or to Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Advance Drafts which had has not been signed by the CardmemberCardholder, if Maybank the Bank is of the view, upon satisfactory documentary evidence, that the omission is due to an oversight on the part of the Cardmember Cardholder and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the CardmemberCardholder;
4.34.9 Pre-authorisation amount of Ringgit Malaysia Two Hundred (RM200) is required for self-service pumps. The Cardmember pre-authorisation amount is a temporary hold from the Cardholder‟s available credit limit in the VISA/MASTERCARD CARD Account before Petrol is filled. The pre-authorisation amount will be cleared within three (3) Calendar Days and the actual amount for petrol transaction will be debited from your VISA/MASTERCARD CARD Account;
4.10 The Cardholder shall comply with all requirements, directions, instructions and guidelines for in connection with the use of the Credit Card VISA/MASTERCARD CARD issued by Maybank the Bank from time to time in respect of all credit, banking VISA/ MASTERCARD CARD facilities and services rendered to the CardmemberCardholder.

4.5 Notwithstanding Clause 4.1 above, a purchase may also be effected by providing the Authorised Merchant the Card Number together with such other particulars as may be recorded on the Card and without the requirement of the Cardmember’s signature as in the case of purchases made through Electronic Commerce, Mail Order, Telephone Order and at specific Point of Sales Terminals including but not limited to transactions at petrol kiosks and/or through such other modes that may be introduced / implemented from time to time.
4.6 Notwithstanding any other Terms and Conditions to the contrary herein set out, the Bank may at its sole and absolute discretion at any point of time with immediate notice decide not to renew, cancel, revoke the card or suspend or restrict the use of card by the Cardmember and/or any supplementary card upon the occurrence of any one of the following events:-
(i) Use the card as payment for any illegal / unlawful purchases made by the Cardmember; or
(ii) Use the card to engage in an Internet gambling transaction done by the Cardmember; or
(iii) Use the card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember”; or
(iv) Use the card as payment for non-Shariah approved transaction.
4.7 Without prejudice to Clause 4.6 herein, if the Cardmember uses the Card for purposes prohibited by the Shariah or for the purchase of non-halal or non Shariah-approved goods or services at businesses or premises, such Cardmember shall nevertheless be fully liable to pay the Bank the amount due in respect of such uses or purchases in accordance with this Agreement and the Cardmember hereby expressly agrees and undertakes that he will not plead such usage as a defence to claim for payment of the amounts due to the Bank or otherwise rely on it to refuse payment of amounts due.

Manner of Use. (a) To effect a 5.1 A credit purchase using the Credit Card from any Authorised Merchant, Merchant using the Cardmember must VISA/MASTERCARD Business Credit Card generally requires the Cardholder to sign on a Sales Draft prepared by the Authorised Merchant with the use Merchant, unless purchases of the Credit Cardgoods and/or services are made or incurred through mail or phone orders, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of the purchase transaction;
(b) To effect a cash withdrawal using the Credit Card from any Authorised Cash Outletself-service terminals, the Cardmember shall sign on a Cash Withdrawal Draft prepared by internet or any similar means.
5.2 The Member and/or Cardholder authorises the Authorised Cash Outlet with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of any Cash Withdrawal transaction;
(c) To effect a cash withdrawal through ATM, the Cardmember shall use the Personal Identification Number (PIN) to gain access to his/her Credit Card Account
(a) Maybank shall purchase from the Authorised Merchant and/or Authorised Cash Outlet all Sales Drafts and Cash Withdrawal Drafts incurred through the use of the Credit Card and is hereby expressly authorised Bank to debit the Cardmember’s VISA/MASTERCARD Business Credit Card Account accordingly.
(b) Notwithstanding for all purchases and/or services made or incurred using the provisions set out in Clause 4.1 above, the Cardmember hereby expressly authorises Maybank to charge hisVISA/her MASTERCARD Business Credit Card Account with in the manner described in this Clause 5. Failure on the part of the Cardholder to sign any payments made to the Authorised Merchant or Authorised Cash Outlet evidenced by Sales Drafts or Cash Withdrawal Drafts which had enter a PIN will not been signed by relieve the CardmemberMember from liability to the Bank in respect thereof, if Maybank the Bank is of the view, upon satisfactory documentary evidence, opinion that the omission is due to the nature of the transaction or due to an oversight on the part of the Cardholder and/or the Authorised Merchant.
5.3 To effect a Cash Advance through the ATM, the Cardmember and/or shall use the PIN to gain access to his VISA/MASTERCARD Business Credit Card Account.
5.4 The Bank however, reserves the right to immediately terminate the credit card facility if the Cardmember is found to have used the VISA/MASTERCARD Business Credit Card for any unlawful activities such as illegal online betting or payment for any illegal purchases.
5.5 In consideration of the Cardholder observing and complying with the terms of this Agreement, the Bank shall purchase from the Authorised Merchant or Authorised through any member institution of Visa International or MasterCard International all Sales Drafts and Cash Outlet or if Withdrawal Drafts incurred by the Authorised Merchant has undercharged Cardholder and debit the CardmemberCardholder's VISA/MASTERCARD Business Credit Card Account accordingly.
4.3. 5.6 The Cardmember Cardholder shall comply with all requirements, directions, instructions and guidelines for in connection with the use of the VISA/MASTERCARD Business Credit Card issued by Maybank the Bank from time to time in respect of all credit, banking VISA/MASTERCARD Business Credit Card facilities and services rendered to the CardmemberCardholder.
4.4. a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember;

4.3. 4.3 The Cardmember shall comply with all requirements, directions, instructions and guidelines for use of the Credit Card issued by Maybank from time to time in respect of all credit, credit and banking facilities and And services rendered to the Cardmembercardmember.

(c) The Cardmember shall be liable for all charges and advances whatsoever arising from all transactions, whether authorised or unauthorised, effected with the Credit Card.

4.7 Notwithstanding any provisions to the contrary herein set out, Maybank may at its sole and absolute discretion at any point of time or without notice decide not to renew, cancel, revoke the Credit Card or suspend or restrict the use of Credit Card by the Cardmember and/or any Supplementary Credit card without assigning any reason thereof upon the occurrence of any one of the following events :
a) Use the Credit Card/Supplementary Credit Card as payment for any illegal purchases; or

d) Use the Credit Card/Supplementary Credit Card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember/Supplementary Credit Cardmember”.

4.7 Notwithstanding any other provisions to the contrary herein set out, Maybank may at its sole and absolute discretion at any point of time with or without notice can decide not to renew, cancel, revoke the Credit Card or suspend or restrict the use of Credit Card by the Cardmember and/or any supplementary Credit Card upon the occurrence of any one of the following events:
(a) Use the Credit Card as payment for any illegal purchases; or
(b) Use the Credit Card as payment for any unlawful transaction such as illegal online betting; or
(c) Use the Credit Card to purchase goods or services that will be resold i.e. “not for personal use of the Cardmember.”

Manner of Use. Salix (or its Sublicensees) shall use the Licensed Trademarks in accordance with sound trademark and name usage principles and in accordance with Applicable Law as reasonably necessary to maintain the validity and enforceability of the Licensed Trademarks. Additionally, Salix (or its Sublicensees) shall:
(a) To effect a purchase using the Credit Card from not use any Authorised MerchantLicensed Trademarks in any manner that might tarnish, disparage, or reflect adversely, as those terms are reasonably construed, on Photocure, the Cardmember must sign on a Sales Draft prepared by Lumacan Products or the Authorised Merchant with the use of the Credit Card, but the signature shall not be a condition precedent to the liability of the Cardmember in respect of the purchase transactionLicensed Trademarks;
(b) To effect a cash withdrawal using promote and sell Lumacan Products under only the Credit Card from any Authorised Cash Outlet, the Cardmember shall sign on a Cash Withdrawal Draft prepared trademark “LUMACAN” and other Licensed Trademarks as expressly agreed to in writing by the Authorised Cash Outlet with Parties, except that Salix may add the use name “Salix” or any other company name belonging to Salix (or its Sublicensees, subject to Applicable Law) to the Product Labeling; provided that all Product Labeling and packaging shall in any case identify Photocure as licensor of the Credit Cardrelevant Lumacan Product, but unless prohibited by Applicable Law; provided, further, that from and after the signature Authorized Generic Product Commencement Date the provisions of this subsection (b) shall not be a condition precedent to the liability of the Cardmember apply in respect of any Cash Withdrawal transactionthe promotion and sale by Salix or its Affiliates or Sublicensees of an Authorized Generic Product;
(c) To effect a cash withdrawal through ATMnot use any Licensed Trademarks in any manner that suggests an agency, the Cardmember shall use the Personal Identification Number (PIN) to gain access to his/her Credit Card Accountpartnership, or joint venture relationship with Photocure;
(ad) Maybank shall purchase from not use any Licensed Trademarks as part of its corporate or business names;
(e) comply with the Authorised Merchant and/or Authorised Cash Outlet all Sales Drafts reasonable requirements of Photocure as to the form, manner, scale and Cash Withdrawal Drafts incurred through the context of use of the Credit Card Licensed Trademarks and is hereby expressly authorised to debit of the Cardmember’s Credit Card Account accordingly.statements required under Section 10.2(g) below;
(bf) Notwithstanding display the provisions set out proper form of trademark notice associated with the Licensed Trademarks, as notified to Salix in Clause 4.1 abovewriting by Photocure;
(g) include, on any Product Labeling that bears a Licensed Trademark, a statement identifying Photocure as the Cardmember hereby expressly authorises Maybank owner of such Licensed Trademark and where possible indicating that Salix (or its Sublicensee, subject to charge his/her Credit Card Account with Applicable Law) is an authorized user of such Licensed Trademark, unless prohibited by Applicable Law;
(h) neither use nor display any payments made Licensed Trademarks in such relation to the Authorised Merchant any other xxxx or Authorised Cash Outlet evidenced marks owned by Sales Drafts any Third Party or Cash Withdrawal Drafts which had not been signed by the Cardmember, if Maybank is of the view, upon satisfactory documentary evidence, Salix or its Sublicensees as to suggest that the omission is due multiple marks constitute a single or composite trademark or service xxxx or are under the same proprietorship; and
(i) subject to an oversight on the part of the Cardmember and/or the Authorised Merchant or Authorised Cash Outlet or if the Authorised Merchant has undercharged the Cardmember
4.3. The Cardmember shall comply with Article 14, discontinue all requirements, directions, instructions and guidelines for use of the Credit Card issued by Maybank from time to time in respect Licensed Trademarks immediately upon expiration or termination of all credit, banking facilities and services rendered to the Cardmemberthis Agreement.
4.4. a) Maybank shall be entitled to treat its record of transaction effected by the use of the Credit Card including but not limited to transaction effected via mail order or telephone as evidence of a debt properly incurred by the Cardmember to be debited to the account of the Cardmember;
