Market Concentrations Sample Clauses

Market Concentrations. 6.3.1 The Commission has adopted the Xxxxxxxxxx-Xxxxxxxxx Index (“HHI”) method in calculating market concentrations. According to calculations following the HHI, results show that a few of the Relevant Markets are concentrated. The US Department of Justice (“US DOJ”) considers an HHI of less than 1,500 to be a competitive marketplace, an HHI of 1,500 to 2,500 to be a moderately concentrated marketplace, and an HHI of 2,500 to be a highly-concentrated marketplace. It should be noted, however, that the US DOJ thresholds apply to all industries and may not be a true and accurate indicator for aviation service markets. Due to the particular features of the aviation service industry, in that there are high sunk costs for operators wishing to enter the industry, resulting in fewer players in the market, higher market concentrations may be more common as compared to other industries. The Commission bases its HHI numbers on US DOJ thresholds but the thresholds will not be treated as a definitive indicator of market concentration. The HHI for each market is shown in Appendix VII. 6.3.2 Out of the eleven (11) Relevant Markets, five (5) of the markets are considered to be highly-concentrated, with the highest concentration being the Seattle-Kuala Lumpur market with an HHI of 5,349. In this market however, the Parties have a combined market share of 4.6% as compared to their competitor with the highest share of 72.1%, and the Commission considers this as insignificant. The market concentration in the DEN-KUL market in which the Parties have the highest market share will be addressed separately in Paragraph 6.4 below.
