Maximum Compensatory Time All Employees except IAFF Clause Samples
The "Maximum Compensatory Time All Employees except IAFF" clause sets a limit on the amount of compensatory (comp) time that employees, excluding those represented by the International Association of Fire Fighters (IAFF), can accrue in lieu of overtime pay. Typically, this means that when eligible employees work overtime, they may choose to receive comp time up to a specified maximum threshold instead of immediate overtime wages. For example, an employee might be allowed to accumulate up to 80 hours of comp time, after which any additional overtime must be paid out as wages. This clause ensures that comp time balances remain manageable for both employees and the employer, preventing excessive accruals and helping to control labor costs and scheduling complexities.
Maximum Compensatory Time All Employees except IAFF. Employees may accumulate no more than the maximum number of hours of compensatory time allowed under the federal Fair Labor Standards Act. Employees may accumulate no more than four hundred eighty (480) hours of compensatory time. IAFF members may accrue compensatory time throughout the biennium. The employee’s compensatory time balance will be cashed out on the last day of the biennium or when the employee:
1. Leaves state service for any reason;
2. Transfers to a position in their agency with different funding sources; or
3. Transfers to another state agency.
