Common use of Minimum Wage Gap Guarantee Clause in Contracts

Minimum Wage Gap Guarantee. After the date of ratification, in the event of a minimum wage increase in the Province, the Company will provide all employees with an adjusted increase in their pay classifications of not less than the same amount as the minimum wage increase. This increase will be effective on the date of the next annual increase. (Example: Assume that the minimum wage increases on April 1, 2009 and the employees receive their annual increase on July 1, 2009. On July 1st each employee will receive an adjusted increase of not less than the increase in the Provincial minimum wage. To clarify this let us assume that on July 1, 2009, the rate category shows the employee is to receive a thirty-six (36¢) cents an hour increase. The minimum wage has increased forty (40¢) cents per hour on April 1st. In this case the employees will receive forty (40¢) cents an hour increase effective on July 1st. If the annual increase is more than the increase in the Provincial minimum wage then the employee will receive only their annual increase.)
