Common use of Minority and Women's Business Enterprises Commitment Clause in Contracts

Minority and Women's Business Enterprises Commitment. In the performance of this Agreement, including the procurement and lease of materials or equipment, Contractor must abide by the minority and women's business enterprise commitment requirements of the Municipal Code of Chicago (“Municipal Code”), §2-92-420 et seq. (1990), except to the extent waived by the Chief Procurement Officer and the Special Conditions Regarding MBE/WBE Commitment set forth in Exhibit 3. Contractor's completed Schedules C-1 and D-1 in Exhibit 3, evidencing its compliance with this requirement, are a part of this Agreement, upon acceptance by the Commissioner. Contractor must utilize minority and women's business enterprises at the greater of the amounts listed in those Schedules C-1 and D-1 or the percentages listed in them as applied to all payments received from the City. For all things relating to MBE/WBE compliance, those functions, including the ones described in Exhibit 11 Supplemental Contract Terms Relating to Executive Order 2021-1, will be performed by the Commissioner and not the CPO. However, firms will be certified by the City’s Department of Procurement Services.
