Common use of Misrepresentation or Falsification of Information Clause in Contracts

Misrepresentation or Falsification of Information. If the Department determines that Contractor has misrepresented or falsified information furnished to a Potential Enrollee, Prospective Enrollee, Enrollee, or Provider, the Department may impose a civil money penalty of $10,000.00 to $25,000.00. If the Department determines that Contractor has misrepresented or falsified information furnished to the Department or Federal CMS, the Department may impose a civil money penalty of $10,000.00 to $50,000.00.
