Confidentiality of Information. 8.1. By accessing this EHSAN AUCTIONEERS SDN. BHD. website, the E-Bidders acknowledge and agree that EHSAN AUCTIONEERS SDN. BHD. website may collect, retain, or disclose the E-Bidder’s information or any information by the e-bidders for the effectiveness of services, and the collected, retained or disclosed information shall comply with Personal Data Protection Act 2010 and any regulations, laws or rules applicable from time to time. 8.2. E-Bidders agree to accept all associated risks when using the service in the EHSAN AUCTIONEERS SDN. BHD. website shall not make any claim for any unauthorized access or any consequential loss or damages suffered. 8.3. E-Bidders shall be responsible for the confidentiality and use of password and not to reveal the password to anyone at any time and under any circumstances, whether intentionally or unintentionally. 8.4. E-Bidders agree to comply with all the security measures related to safety of the password or generally in respect of the use of the service. 8.5. E-Bidders accept the responsibility that in any event that the password is in the possession of any other person whether intentionally or unintentionally, the E-Bidders shall take precautionary steps for the disclosure, discovery, or the Bidders shall immediately notify EHSAN AUCTIONEERS SDN. Confidentiality of Information. 12.1. By accessing the Auctioneer’s website i.e. xxx.xxxxxxxxxxxxxxxx.xxx, all online E-Bidder acknowledge and agree that the Auctioneer and its website may collect, retain, or disclose the online E-Bidder information or any information by the Online Bdders online E-Bidder for the effectiveness of services and the collected, retained or disclosed information shall comply with Personal Data Protection Act 2010 and any regulations, laws or rules applicable from time to time.
Confidentiality of Information. (a) All information disclosed by a Party in connection herewith and considered by such Party to be confidential, proprietary or of a competitive value shall be kept confidential by the other Party so long as such information is marked "confidential" or "proprietary" at the time of disclosure, or if disclosed orally, the receiving Party confirms promptly in writing that such information is to be treated as confidential for purposes of this Agreement ("Confidential Information"). Each Party shall only be permitted to disclose Confidential Information of the other Party to its Affiliates and its and its Affiliates' officers, directors, employees, agents, consultants, and contractors who need to know such Confidential Information for the purpose of implementing, enforcing, or interpreting this Agreement (but only so long as the disclosure of such information to such persons and the use of such Confidential Information thereby complies with the requirement of applicable FERC standards or codes of conduct). Confidentiality of Information. Each Party shall ensure the confidentiality of electronic communications and related traffic data by means of a public communication network and publicly available electronic communication services without restricting trade in services.
Confidentiality of Information. (a) Owner and Servicer shall not disclose any confidential or proprietary information of the other party with respect to such other party, the Mortgage Loans, or the Mortgage Files that may be in the possession of that party (the “Confidential Information”) to any Person who is not a partner, officer, employee, counsel, or agent of such party except with the written consent of such other party or pursuant to a subpoena or order issued by a court or by an administrative, legislative, or law enforcement agent, department, agency, body or committee. (b) The Owner and the Servicer shall not be required to treat as Confidential Information, any information of the other party if (i) such information is already in the possession of the party and is not otherwise subject to any agreement as to confidentiality, (ii) such information is or becomes generally available in the public domain other than as a result of a disclosure by the party or its partners, officers employees, counsel, or agents, (iii) such information is not acquired from the other party or Persons known to be in breach of an obligation of secrecy to such other party, (iv) such information is contained in or derived from the Mortgage File, or (v) such information is statistical in nature, and the Servicer or the Servicer’s counsel determines it is reasonably required to be disclosed in connection with the securitization or other transfer of mortgage loans (other than the Mortgage Loans) sold by Servicer. (c) Neither of the parties to this Agreement nor any of their Affiliates shall issue any press release or public announcement concerning the contemplated transaction, the existence of this Agreement, the terms, conditions, and provisions of this Agreement, or any of the party’s Confidential Information, (i) unless mutually agreed by the parties or (ii) except as required by law, in which event the disclosing party shall consult with the other party to the extent practicable before making such disclosure.
Confidentiality of Information. Each party recognizes that, in connection with this Agreement, it may become privy to non-public information regarding the financial condition, operations and prospects of the other party.
