Mutilated or Missing Certificates. If any Warrant or Unit Certificate is mutilated, lost, stolen or destroyed, the Company and the Transfer Agent may, on such terms as to indemnity or otherwise as they may in their discretion impose (which shall, in the case of a mutilated Warrant or Unit Certificate, include the surrender thereof), and upon receipt of evidence satisfactory to the Company and the Transfer Agent of such mutilation, loss, theft or destruction, issue a substitute Warrant or Unit Certificate, respectively, of like denomination or tenor as the Warrant or Unit Certificate so mutilated, lost, stolen or destroyed. Applicants for substitute Warrant or Unit Certificates shall comply with such other reasonable regulations and pay any reasonable charges as the Company or the Transfer Agent may prescribe.

Mutilated or Missing Certificates. If this Certificate is mutilated, lost, stolen or destroyed, the Company will issue and deliver in substitution for and upon cancellation of the mutilated Certificate, or in substitution for the Certificate lost, stolen or destroyed, a new Certificate of like tenor and representing an equivalent right or interest, but only upon, in the case of a lost, stolen or destroyed certificate, receipt of evidence satisfactory to the Company of such loss, theft or destruction.
Mutilated or Missing Certificates. In case any CVR Certificate shall be mutilated, lost, stolen or destroyed, Newbridge may in its discretion issue, and the Rights Agent may countersign and deliver in exchange and substitution for an upon cancellation of the mutilated CVR Certificate, or in lieu of a substitution for the lost, stolen or destroyed CVR Certificate, a new CVR Certificate of like tenor and evidencing the number of CVRs evidenced by the CVR Certificate so mutilated, lost, stolen or destroyed, but only upon receipt of evidence satisfactory to the Rights Agent of such mutilation, loss, theft or destruction of such CVR Certificate and indemnity, if requested, also satisfactory to it. Applicants for such substitute CVR Certificate shall also comply with such other reasonable regulations and pay such other reasonable charges as Newbridge or the Rights Agent may prescribe. Any such new CVR Certificate shall constitute an original contractual obligation of Newbridge, whether or not the allegedly mutilated, lost, stolen or destroyed CVR Certificate shall be at any time enforceable by anyone.
Mutilated or Missing Certificates. On receipt by the Company and the Agent of evidence satisfactory as to the ownership of and the loss, theft, destruction or mutilation of any Certificate, the Company shall execute and the Agent shall countersign and deliver in lieu thereof, a new Certificate representing an equal aggregate number of Units or Warrants as the case may be. In the case of loss, theft or destruction of any Certificate, the Holder requesting issuance of a new Certificate shall be required to secure an indemnity bond from an approved surety bonding company. In the event a Certificate is mutilated, such Certificate shall be surrendered and canceled by the Agent prior to delivery of a new Certificate. Applicants for a substitute Certificate shall also comply with such other regulations and pay such other reasonable charges as the Agent may prescribe.

Mutilated or Missing Certificates. In case any certificate or other document issued to Holdings hereunder evidencing the Purchased Shares, the Warrant, the Remaining Rights Shares, the Additional Shares, the shares issued under the Bridge Note or the shares issued upon the exercise of the Warrant shall be mutilated, lost, stolen, or destroyed, the Company shall issue and deliver a new certificate or other document of like tenor representing an equivalent right or interest in exchange and substitution for such certificate, and the Company shall cancel such mutilated, lost, stolen or destroyed certificate or other document, but only upon receipt of evidence satisfactory to the Company of such loss, theft or destruction; the affidavit of the holder of record, without bond but with promise of indemnity, shall be satisfactory evidence of such loss, theft or destruction. The applicant for such replacement instrument or certificate shall also comply with such other reasonable regulations as the Company may prescribe.
Mutilated or Missing Certificates. Upon receipt by Company of evidence reasonably satisfactory to it of the loss, theft, destruction or mutilation of any Warrant Certificate, and (in the case of loss, theft or destruction) of indemnity satisfactory to it, and upon reimbursement to Company of all reasonable expenses incidental thereto, and upon surrender and cancellation of such Warrant Certificate, if mutilated, company will promptly make and deliver in lieu of such Warrant Certificates a new Warrant Certificate of like tenor and representing the same number of Warrants.
