The Applicant Sample Clauses
The Applicant. (1) Any resident or national of a Contracting State may file an international application.
(2) The Assembly may decide to allow the residents and the nationals of any country party to the Paris Convention for the Protection of Industrial Property which is not party to this Treaty to file international applications.
(3) The concepts of residence and nationality, and the application of those concepts in cases where there are several applicants or where the applicants are not the same for all the designated States, are defined in the Regulations.
The Applicant. (a) The request shall indicate:
(i) the name,
(ii) the address, and
(iii) the nationality and residence of the applicant or, if there are several applicants, of each of them.
(b) The applicant’s nationality shall be indicated by the name of the State of which he is a national.
(c) The applicant’s residence shall be indicated by the name of the State of which he is a resident.
(d) The request may, for different designated States, indicate different applicants. In such a case, the request shall indicate the applicant or applicants for each designated State or group of designated States.
(e) Where the applicant is registered with the national Office that is acting as receiving Office, the request may indicate the number or other indication under which the applicant is so registered.
The Applicant. As to the indications concerning the applicant, Rules 4.4 and 4.16 shall apply, and Rule 4.5 shall apply mutatis mutandis.

The Applicant. 5.1.1 is unable or admits inability to pay its debts as they fall due;
5.1.2 is deemed to, or is declared to, be unable to pay its debts under applicable law;
5.1.3 suspends or threatens to suspend making payments on any of its debts; or
5.1.4 by reason of actual or anticipated financial difficulties, commences negotiations with one or more of its creditors (excluding the LTA TF) with a view to rescheduling or reducing any of its indebtedness.

The Applicant. 2.1 Obligations of the Applicant In submitting the Application Form the Applicant:
(a) certifies that they have read and understood the “Environmental Upgrade Agreement”, which can be found by clicking the Council logo at xxxxx://xxxxxxxxxxxxxxxxxxxxx.xxx.xx/xxxxxxxx/;
(b) authorises the Better Building Finance to obtain from the Mornington Peninsula Shire Council property and rates information in respect of the property that is the subject of the Application necessary for verifying your eligibility for environmental upgrade finance;
(c) agrees that they will provide annual reporting on energy, water and other savings generated by the proposed environmental upgrade works to the Better Building Finance, and understands that this information may be used to develop media and communications materials, fact sheets and case studies and to measure program performance;
(d) agrees to pay all other applicable fees if the application is successful and the applicant proceeds with the project under an Environmental Upgrade Agreement.
2.2 Warranties and Indemnities provided by the Applicant
(a) The Applicant warrants that all statements, information, documents and representations made and provided by the Applicant in connection with the Application are true and correct.
(b) The Applicant acknowledges that the Better Building Finance will rely on the correctness of the above statements, information, documents and representations when processing the Application and, if the Application is successful, when considering the project under an Environmental Upgrade Agreement.
(c) The Applicant agrees to indemnify the Better Building Finance and Mornington Peninsula Shire Council against any loss or damage whatsoever suffered as a result of any action, proceeding, claim, demand, prosecution or circumstance arising out of the performance, non-performance or breach by the Applicant of any warranty in connection with the Application.

The Applicant. 8.3.1 is or becomes unable or admits inability to pay the Applicant's debts as they fall due;
8.3.2 is deemed to, or is declared to, be unable to pay the Applicant's debts under applicable law;
8.3.3 suspends or threatens to suspend making payments on any of the Applicant's debts; and
8.3.4 by reason of actual or anticipated financial difficulties, commences negotiations with one or more of the Applicant's creditors with a view to rescheduling any of the Applicant's indebtedness; or
