Mutual Rights. In the event of the unexcused failure on the part of an aggrieved party to be timely, the grievance shall be deemed to be withdrawn. If the employer or their representative fail to make a decision within the required time period, the grievance may be appealed to the next step in a timely manner, except at step three, the grievance shall be deemed to be upheld and in all respects final and binding upon the parties.
