Common use of NDA Clause in Contracts

NDA. It is contemplated that each Party may disclose certain information to the other in the course of performing this Agreement. With regards to such information, each Party agrees to comply with and be bound by the terms and conditions of the non-disclosure agreement (“NDA”) between the Parties (if any), during the term of this Agreement or the term specified in the NDA, whichever is longer. The terms and conditions of the NDA (if any) are incorporated herein by reference. If no such NDA exists, the Parties agree to comply with Sections 9(c)-(e) below.
