System Data. (a) In connection with Dell’s performance or Partner’s or End-User’s use of the Products, Services, and Service Software, Dell may collect system data on the configuration, operation, performance and use of Products, Services, and Service Software through a telemetry collector (“System Data”), provided that this does not encompass any production data stored or processed by End User on or with a Product or Service. Partner’s or End User’s disablement of such features may entail disruption or disablement of the Product, Service or Service Software, as advised by Dell in the documentation or otherwise. System Data may be: (i) used by Dell or (ii) shared with third parties for lawful technical and commercial purposes, provided that any transfer by Dell to third parties requires appropriate protection of the confidentiality of End Customer and Partner-specific information and must be in line with applicable laws. (b) Dell shall exclusively own and retain all rights in System Data that is anonymized, i. e. that neither identifies Partner, nor End User, nor is personally identifiable with an individual, and such data shall be considered Confidential Information of Dell. (c) Partner shall notify End-Users that Dell collects and uses System Data relating to the performance or use of Products, Services, and Service Software as described in subsection (a) of this System Data section. Partner shall provide Dell the rights for System Data as set forth in subsections (a) and (b) of this System Data section in its End User agreements. Partner must include the Telemetry Data Provision located in the Offering Specific Terms in the respective End-User agreements for the purchase of Products or Services.

System DataTo the extent that System Data identifies or permits, alone or in conjunction with other data, identification, association, or correlation of or with Buyer, its Affiliates, Users, customers, suppliers or other persons interacting with any of the foregoing, or any Confidential Information of Buyer or any device as originating through or interacting with Buyer or its Affiliates (“Identifiable System Data”), Licensor may only collect and use Identifiable System Data internally to provide and improve the Software and Services and Licensor’s other products and services. Licensor will not target any data analysis at, or otherwise use any Identifiable System Data to derive or attempt to derive information regarding, Buyer and its Affiliates, their businesses, operations, finances, users, customers, prospective customers, suppliers or other persons interacting with Buyer and its Affiliates. Licensor will not target any development efforts, marketing, communications or promotions arising from its use of Identifiable System Data at Buyer and its Affiliates or any other person on the basis of the intended recipient’s relationship with Buyer or any of its Affiliates. Licensor will not use or disclose any Identifiable System Data for any other purpose unless otherwise agreed in writing by the Parties.

System Data. (a) usage statistics, system logs, performance and security data, feedback data, records of support requests, and aggregated data about how Our sites, Services, Software, Support and apps are used (e.g. performance counters, access logs, metrics and associated metadata, unique identifiers for devices, technical information about the devices used, the network, operating system and browsers); and (b) data identified as malicious (e.g. malware infections, cyberattacks, Unsuccessful Security Incidents). This excludes Content, Smart Data and Threat Data.

Licensor will not target any development efforts arising from its use of Identifiable System Data at any person on the basis of the intended recipient’s relationship with Buyer or any of its Affiliates or the intended recipient being in same industry or market as Buyer or any of its Affiliates. Licensor will not use or disclose any Identifiable System Data for any other purpose unless otherwise agreed in writing by the Parties, and will, except for the use permitted in this Section, maintain the confidentiality and security of Identifiable System Data as Confidential Information.
System DataNotwithstanding anything to the contrary in this Agreement, SupplyShift has the right to collect and use de-identified technical information pertaining Users’ use the Platform (“System Data”) to develop, improve, support, and operate its products and services during and after the Term of this Agreement. This Section does not give SupplyShift the right to identify Supplier as the source of the System Data without written permission from Supplier.

System DataThe Company purchased from the National Rural Television Cooperative ("NRTC") the right to provide DirecTV programming services to approximately 53,438 Homes passed by cable television services and approximately 18,218 Homes unpassed by cable television services as of 1992. As used herein, "Homes" means single family residences and individual dwelling units within any building containing multiple dwelling units. Schedule 2.26 sets forth the Company's rates for satellite services, a breakdown of the channel packages sold and a general description of marketing promotions and discounts offered to subscribers since December 31, 1996 and those which may affect the Company's business after the Closing Date.
System Data. As of August 31, 1999, the Systems consisted of approximately 3,215 miles of trunk and distribution plant and approximately 97,600 "homes passed" and have approximately 58,395 EBS's. As used in this Agreement, "homes passed" means each single family residence or dwelling unit within a building containing multiple dwelling units plus commercial and other buildings actually served by the Systems, but does not include dwelling units within multiple dwelling unit buildings to which the Company has been denied a right of access to the building by an owner or manager. SCHEDULE 1.6 sets forth as to each System, as of August 31, 1999: (i) the approximate number of miles of plant that will be included in the Assets: (ii) for the eight-month period ended August 31, 1999, the number of subscribers of each of the Systems as reflected in Seller's billing reports; (iii) for the eight-month period ended August 31, 1999, a description of basic and optional or tier services available from the Systems and the rates charged by Seller for each, the number of subscribers receiving each basic and optional or tier service and the rates charged for each, the date and amount of the last rate increase for System service, and an explanation of how subscribers are counted (e.g. does a subscriber with an HBO multiplex count as one or multiple subscribers?); (iv) for each of the years ended December 31, 1997 and 1998, the number of subscribers of each of the Systems and the number of subscribers receiving basic or optional tier services and the rates charged for each; (v) the stations and signals carried by the Systems and the channel position of each such signal and station; (vi) the MHZ of visual and aural signal that such System is capable of delivering to substantially all of such System's subscriber terminals such that the delivered signal meets or exceeds the requirements of part 76, Paragraph 76.605 of the FCC's rules and regulations; (vii) the channel capacity for each of the Systems (including a breakdown of channels utilized and channels available); (viii) the disconnection policies of the Systems; and (ix) the cities, towns, townships, villages and boroughs served by each System.
