No Assignment of Claim. Employee represents that Employee has not assigned or transferred, or purported to assign or transfer, any claims or any portion thereof or interest therein to any party prior to the date of this Release.

Sec. 3727) of the Litigation.

Donnelley hereby represents and warrants that Donnelley is the full and sole owner of the potential claims, demands, actions, or causes of action referred to in this Release Agreement, that Donnelley has full power and authority to execute this Release Agreement, and that the claims or causes of action Donnelley has or may have against the Released Parties, whether known or unknown, which arose or might arise have not been, directly or indirectly, assigned, transferred, or otherwise encumbered (expressly, by operation of law or otherwise).
