No Competitive Products. During the Term of this Agreement and until the Minimum Production Bonus has been paid, the Company agrees that the Company will not offer or sell, directly or indirectly, any product that is competitive with the Male Pro-Health Product developed by Employee in any market in which the Company is lawfully able to offer and sell the Male Pro-Health Product.
No Competitive Products. The Company has no current products, or products in development, for the treatment of chronic hepatitis.
No Competitive Products. Parent has no current products, or products in development, for the treatment of allergic reactions using epinephrine nasal spray.
No Competitive Products. Licensee hereby covenants and agrees that it shall not sell or use any material which may be regarded by the Licensor as directly competitive with the Licensed Material, except upon the express written consent of the Licensor.
No Competitive Products. None of Manufacturer, its affiliates or its agents shall infringe upon any of Buyer’s Trademarks, patent rights, trade secrets, or other intellectual property during the Term or after termination of this Agreement. Manufacturer shall not, nor may its affiliates or agents, during the term of this Agreement or after termination of this Agreement, manufacture, package, market or sell any product that, in Buyer’s sole determination, incorporates or is similar in appearance, construction, design or performance to the characteristics of any Product, including any of the dress design, or appearance encompassed in Buyer’s Trademarks.
No Competitive Products. Company shall not include in the Integrated Software any products whose sale is competitive (i.e. email management software and/or automated email response software) with the Licensed Software.
No Competitive Products. Distributor agrees that it shall not, during the term of this Agreement, directly or indirectly market, sell, license, promote or solicit orders for any Products which are competitive with the Products unless Tekelec consents in writing in advance based upon full disclosure of the material facts by Distributor or, when acting as Systems Integrator, End User directs Distributor to procure such Product.
No Competitive Products. Choten agrees and undertakes not to stock, promote or distribute any product that directly competes with the Products.
No Competitive Products. Noah represents and warrants that it does not currently and will not, during the term of this Agreement, manufacture or otherwise produce, market, promote, distribute or sell, in any manner, directly or indirectly, any products in the Territory which are similar to, in competition with, or that might interfere with the sale of the Products. If, at any time, Noah or any of its affiliates is reasonably deemed by Tegal to be in competition with the Products in the Territory, Tegal may terminate this Agreement immediately by written notice to Noah.
No Competitive Products. During the term of this Agreement, Distributor shall not market, distribute or sell, directly or indirectly, any portable concentrators competitive with Inogen products weighing 5 pounds or less.
