No Negative Amortization. No Capital Contribution; No Financing for Incomplete Improvements. No Mortgage Loan, other than an ARD Loan (and then only after the Anticipated Repayment Date for such ARD Loan), provides for the negative amortization of interest. Neither the Seller nor any affiliate thereof has any obligation to make any capital contributions to the Mortgagor under the Mortgage Loan. The Mortgage Loan was not originated for the purpose of financing the construction of incomplete improvements on the related Mortgaged Property other than tenant improvements.
No Negative Amortization. The Payment Deferment and Due Date Change Policies, as set forth on Exhibit D to the Sale and Servicing Agreement, will not result in the negative amortization of any Subsequent Receivables modified in accordance with such Payment Deferment and Due Date Change Policies.
No Negative Amortization. With respect to any Second Lien Loan, the related First Lien Loan does not permit negative amortization. This representation and warranty is a Deemed Material and Adverse Representation;

Other than the ARD Loans, which may have negative amortization from and after their respective Anticipated Repayment Dates, the Mortgage Loan does not provide for a shared appreciation or equity participation feature, any other contingent or additional interest feature or the negative amortization of interest.

LBAC represents and warrants to the other parties hereto and to the Note Insurer that the amendment to the Payment Deferment and Due Date Change Policies, as set forth on Exhibit A hereto, will not result in the negative amortization of any Receivables modified in accordance with such amended Payment Deferment and Due Date Change Policies.
No Negative Amortization. No Mortgage Loan (other than an Option ARM Mortgage Loan) is subject to negative amortization. No Option ARM Mortgage Loan permits negative amortization in excess of 115% (110%, with respect to each Option ARM Mortgage Loan secured by Mortgaged Property located in the State of New York) of the original principal balance of such Option ARM Mortgage Loan; and
No Negative Amortization. The Mortgage Loan does not provide for negative amortization or for the potential for negative amortization; provided, however, MBF, in its sole discretion, may make advances against particular Mortgage Loans that provide for negative amortization or for the potential for negative amortization.
