No Prior Modifications. Unless otherwise indicated in the related Asset Schedule and reflected in an agreement included in the Mortgage File, no Seller Party nor any prior holder of the Mortgage or the related Mortgage Note has: (i) modified the mortgage or the related Mortgage Note in any material respect; (ii) satisfied, canceled, or subordinated the mortgage in whole or in part; (iii) released the Mortgaged Property in whole or in part from the lien of the Mortgage; or (iv) executed any instrument of release, cancellation, modification, or satisfaction. If a Mortgage Loan has been modified, the modified terms are reflected on the Asset Schedule.

With respect to a Non-Performing Mortgage Loan or Re-Performing Mortgage Loan, if such Mortgage Loan has been modified after acquisition by the related Seller Party, the current and applicable modified terms are reflected on the Asset Schedule and the signed modification documents are in the related loan file and are approved by the Administrative Agent.

Unless otherwise indicated in the related Asset Schedule (including an updated Asset Schedule) and reflected in an agreement included in such Asset File, neither Seller nor any prior holder of the related Mortgage or the related Mortgage Note has: (i) modified such Mortgage or such Mortgage Note in any material respect; (ii) satisfied, canceled, or subordinated the mortgage in whole or in part; (iii) released the related Mortgaged Property in whole or in part from the lien of such Mortgage; or (iv) executed any instrument of release, cancellation, modification, or satisfaction. To the extent such Mortgage Loan has been modified, the modified terms are reflected on the related Asset Schedule and approved by Buyer. The related Mortgage, Mortgage Note and each other related Loan Document contain the entire agreement of the parties and all of the obligations of the related Originator under such Mortgage Loan.
No Prior Modifications. Except as may otherwise be set forth in the related Mortgage Loan Schedule, none of the Mortgage Loans have been modified. None of the Mortgage Loans has been satisfied, canceled or subordinated in whole or in part, except in each case as reflected in an agreement included in the Mortgage File. With respect to each Mortgage Loan, the Mortgaged Property has not been released in whole or in part from the lien of the Mortgage unless otherwise indicated on the Mortgage Loan Schedule.
No Prior Modifications. Citizens has not in any material respect, satisfied, canceled or subordinated any of the Mortgages in whole or in part, released the related Mortgaged Property in whole or in part from the lien of the Mortgage, or executed any instrument of release, cancellation, modification or satisfaction.
No Prior Modifications. With respect to a Non-Performing Mortgage Loan or Re-Performing Mortgage Loan, if such Mortgage Loan has been modified after acquisition by the Seller, such signed modification documents reflecting the applicable modified terms are in the related loan file.
No Prior Modifications. The MH Contract has not been modified, satisfied, canceled or subordinated, in whole or in part, nor has Company waived any material term of the MH Contract, released the MH Contract in whole or in part from the lien of the MH Contract, or executed any instrument of release, cancellation, modification or satisfaction, except in each case as is reflected in an agreement included in the MH Contract File. If an MH Contract has been modified, the modified terms are reflected on the attached Exhibit B. Notwithstanding the foregoing, no such action set forth in instruments or documents identified on the attached Exhibit B (i) waives or otherwise adversely affects the regularly scheduled payments due under such MH Contract, (ii) adversely affects the ability of the holder of such MH Contract to realize upon the collateral securing such MH Contract, or (iii) adversely affects, contravenes or nullifies any representation or warranty made by the Principals pursuant to this Agreement.
No Prior Modifications. Unless otherwise noted on the Mortgage Loan Schedule, none of the Mortgage Loans have been modified in any material respect.
