No Ratification of Unauthorized Use. No act or failure to act by the City with regard to any Unauthorized Attachments shall be deemed as ratification of the unauthorized use. Unless the parties agree otherwise, a Permit for a previously Unauthorized Attachment shall not operate retroactively or constitute a waiver by the City of any of its rights or privileges under this Use Agreement or otherwise, and Company shall remain subject to all obligations and liabilities arising out of or relating to its unauthorized use.

  • Notice of Unauthorized Use The Receiving Party will notify the Disclosing Party promptly upon discovery of any unauthorized use or disclosure of Confidential Information or any other breach of this Agreement by the Receiving Party.
