Protection from Unauthorized Use. The Licensee shall ensure that the Participating Institutions will use reasonable efforts to restrict access to the Licensed Materials to the Authorized Users in the case of their unauthorized use of the Licensed Materials.
Protection from Unauthorized Use. Licensee shall use reasonable efforts to protect the Licensed Materials from any use that is not permitted under this Agreement. In the event of any unauthorized use of the Licensed Materials by an Authorized User, (a) Licensor may terminate such Authorized User's access to the Licensed Materials, (b) Licensor may terminate the access of the Internet Protocol ("IP") address(es) from which such unauthorized use occurred, and/or (c) Licensee shall terminate such Authorized User's access to the Licensed Materials upon Licensor's request. Licensor shall take none of the steps described in this paragraph without first providing a sixty (60) day notice to Licensee and cooperation with the Licensee to avoid recurrence of any unauthorized use.
Protection from Unauthorized Use. Members shall make reasonable efforts to limit access to the Licensed Materials to Authorized Users, and to protect the Licensed Materials from unauthorized use. Neither the Licensee nor the Members are liable to the Licensor in respect of any such unauthorized use so long as such reasonable efforts were made.
Protection from Unauthorized Use. The Licensee and each Member shall use reasonable efforts to protect the Licensed Materials from any use that is not permitted under this Agreement. Upon becoming aware of any unauthorized use or other breach, the Member shall inform Licensor in a timely manner and take reasonable and appropriate steps to ensure that such activity ceases and to prevent any future recurrence. Both parties agree to cooperate in good faith and provide sufficient exchange of information to prevent any further unauthorized use. In the event of any substantial unauthorized use of the Licensed Materials by an Authorized User: (a) Licensor may terminate such Authorized User’s access to the Licensed Materials; (b) Licensor may suspend access through the Internet Protocol (“IP”) addresses from which such unauthorized use occurred, limited to the specific IP address or subnet from which the use occurred; or (c) Licensee or Member Institutions shall terminate such Authorized User’s access to the Licensed Materials upon Licensor’s request. Licensor shall take none of the steps described in this paragraph without first providing written notice to both Licensee and the relevant Member Institutions.

Protection from Unauthorized Use. Licensee shall use reasonable efforts to protect the Licensed Materials from any use that is not permitted under this Agreement. Should Licensor become aware of a suspected unauthorized use of the material, Licensor will immediately notify Licensee of the suspected violation, and will consult with Licensee as to how such unauthorized use can be stopped and its reoccurrence prevented. Because legitimate activity (for example, access from a proxy server address or authorized data mining for research purposes) can sometimes be mistaken for systematic abuse, whenever possible providers should employ appropriate techniques to detect true misuse and follow industry standards in this area as they emerge. In no case will unauthorized use entitle the Licensor to terminate this license prior to 15 days after the date of notice to Licensee described in this section.

Licensee shall secure that Participating Institutions will use reasonable efforts to restrict access to the Licensed Materials to Authorized Users, including but not limited to by issuing and terminating passwords within its control, verifying the status of Authorized User, providing lists of valid passwords or set of IP addresses to Licensor if applicable, updating such lists on a regular basis and providing any information or assistance necessary for Licensor to implement whatever user authentication processes it may establish, if such cooperation or assistance is not in breach of the law. Licensee shall notify Licensor if it shall be aware of any Participating Institution which is not in compliance with this provision.
