No Right to Opt Out. Because the Settlement Class will be certified as a mandatory class under Federal Rule of Civil Procedure 23(b)(2), which does not provide an opportunity for Settlement Class Members to opt out, Settlement Class Members shall not be permitted to opt out of the Settlement Class.
