Nomination and Matching Process. 3.1 The nomination and matching process for the VIP-TTF-NCG-L and any remaining related Interconnection Point shall be carried out in accordance with EASEE-gas CBP 2014-001/01 where: a OGE shall act as Matching System Operator, b GTS shall act as Initiating System Operator, c OGE shall act as Active System Operator and d GTS shall act as Passive System Operator. 3.2 Deviating from Article 3.1, the Single-sided Nomination process shall only apply for New Capacity Contracts. 3.3 Swaps and nominated OBA corrections for an Interconnection Point shall be included in the VIP matching process. 3.4 TG and OGE shall receive each the nominations for their Existing Capacity Contracts. TG shall receive nominations for all New Capacity Contracts at the German side of the VIP. TG shall send the received nominations for New Capacity Contracts at the German side of the VIP and for its Existing Capacity Contracts to OGE. GTS and OGE shall aggregate same shipper code pair nominations for all New Capacity Contracts and Existing Capacity Contracts to perform the matching process between GTS and OGE. 3.5 OGE shall send the results of the matching process for the New Capacity Contracts at the German side of the VIP and the Existing Capacity Contracts of TG to TG. 3.6 In case of a mismatch of an aggregated shipper code pair containing nominations of New Capacity Contracts and Existing Capacity Contracts GTS and OGE divide the matched result proportional to the original nomination of the Existing Capacity Contracts and New Capacity Contracts.

OGE shall operate as Active System Operator. In case a shipper requests Single-sided Nomination for Existing Capacity Contracts, the Parties shall cooperate to find a solution for this request. 3.3 In the Matching procedure OGE shall operate as Initiating System Operator, Fluxys shall operate as Matching System Operator. 3.4 Single-sided Nomination rules shall only apply for the VIP THE-ZTP. 3.5 Nominated VIP THE-ZTP OBA corrections and swaps for an Interconnection Point shall be included in the VIP THE-ZTP matching process. 3.6 To perform the matching with Fluxys, OGE shall aggregate all Nominations on the German side from the VIP THE-ZTP and the Interconnection Points Eynatten- Raeren (OGE), Eynatten (FT), Lichtenbusch (TG) and Eynatten 1 (GASCADE) on shipper code pair level. 3.7 In case of a mismatch of an aggregated shipper code pair containing nominations of New Capacity Contracts and Existing Capacity Contracts, Fluxys and OGE shall divide the matched result proportionally to the original nomination of the Existing Capacity Contracts and New Capacity Contracts. Nomination and Matching Process. 2.1. The exchange of information and the Matching Process between Energinet and Gaz- System shall be made in accordance with the NC INT. 2.2. The Nomination and Matching Process shall be performed on basis of the related Business Requirement Specification of the Nomination and Matching Process (NOM BRS) as amended from time to time. 2.3. Both Parties are responsible for the Matching Process, but Energinet performs the matching calculation. 2.4. Each Party receives Nominations from its Shippers in accordance with the procedures established under the respective transportation agreements (“Shipper Nominations”). Such Shipper Nominations shall be exchanged between the Parties to check the consistency of the upstream and down-stream Shipper Nominations (in either direction). The Shippers shall be informed by their respective TSO of the result of the Matching Process. The results of the Matching Process shall be the Confirmed Quantities communicated to the Shippers. 2.5.   • Testing Procedure Limitations The Asset Representations Reviewer will only be required to perform the testing procedures listed under “Tests” in Schedule A, and will have no obligation to perform additional procedures on any Subject Lease or to provide any information other than a Review Report indicating for each Subject Lease whether there was a Test Pass or a Test Fail for each Test, or whether the Subject Lease was a Test Complete and the related reason. However, the Asset Representations Reviewer may provide additional information about any Subject Lease that it determines in good faith to be material to the Review.

  • Post-Commercial Operation Date Testing and Modifications Each Party shall at its own expense perform routine inspection and testing of its facilities and equipment in accordance with Good Utility Practice as may be necessary to ensure the continued interconnection of the Large Generating Facility with the Participating TO’s Transmission System in a safe and reliable manner. Each Party shall have the right, upon advance written notice, to require reasonable additional testing of the other Party’s facilities, at the requesting Party’s expense, as may be in accordance with Good Utility Practice.

  • Follow-up Testing An employee shall submit to unscheduled follow-up drug and/or alcohol testing if, within the previous 24-month period, the employee voluntarily disclosed drug or alcohol problems, entered into or completed a rehabilitation program for drug or alcohol abuse, failed or refused a preappointment drug test, or was disciplined for violating the provisions of this Agreement and Employer work rules. The Employer may require an employee who is subject to follow-up testing to submit to no more than six unscheduled drug or alcohol tests within any 12 month period.

  • Contractor Certification for Contractor Employees Introduction Texas Education Code Chapter 22 requires entities that contract with school districts to provide services to obtain criminal history record information regarding covered employees. Contractors must certify to the district that they have complied. Covered employees with disqualifying criminal histories are prohibited from serving at a school district. Definitions: Covered employees: Employees of a contractor or subcontractor who have or will have continuing duties related to the service to be performed at the District and have or will have direct contact with students. The District will be the final arbiter of what constitutes direct contact with students. Disqualifying criminal history: Any conviction or other criminal history information designated by the District, or one of the following offenses, if at the time of the offense, the victim was under 18 or enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure; or (c) an equivalent offense under federal law or the laws of another state. I certify that: NONE (Section A) of the employees of Contractor and any subcontractors are covered employees, as defined above. If this box is checked, I further certify that Contractor has taken precautions or imposed conditions to ensure that the employees of Contractor and any subcontractor will not become covered employees. Contractor will maintain these precautions or conditions throughout the time the contracted services are provided. OR SOME (Section B) or all of the employees of Contractor and any subcontractor are covered employees. If this box is checked, I further certify that: (1) Contractor has obtained all required criminal history record information regarding its covered employees. None of the covered employees has a disqualifying criminal history.
