Common use of NON-COLLUSIVE BIDDING REQUIREMENT Clause in Contracts

NON-COLLUSIVE BIDDING REQUIREMENT. In accordance with Section 2878 of the Public Authorities Law, if this Agreement was awarded based upon the submission of bids, Vendor warrants, under penalty of perjury, that its bid was arrived at independently and without collusion aimed at restricting competition. Vendor further warrants that, at the time Vendor submitted its bid, an authorized and responsible person executed and delivered to NYSERDA a non-collusive bidding certification on Vendor’s behalf.
