Conference Requirement and Procedure. (i) The Employer, or the Employer’s representative, shall, when requested by the Employees or their Employee Representative/ Union Delegate, confer (within a reasonable period of time which should not exceed 1/2 hour) for the purpose of determining whether or not conditions are inclement.
(ii) Provided that if the Employer or the Employers’ representative refuses to confer within such reasonable period, Employees shall be entitled to cease work for the rest of the day and be paid inclement weather.

If the employer and the employee agree the area they are working in is unsafe, the following shall apply; Where practical employees will accept being transferred to an area or site that is not affected by inclement weather, if in the opinion of the Employer that useful work can be carried out at the alternative area or site. When the above is not possible, employees will be encouraged to use non-productive time in further skills training or job planning when the situation permits this to occur. Such training shall be relevant and meaningful and will be carried out by a suitably competent person and where practicable shall be completed to an appropriate stage. The training shall include: * Quality Assurance, * Safety, * Environmental, * Industry recognised programmes, * NBCITC Accredited Modules, * Other training relevant to the project. Subject to compliance with the above, employees will continue to be paid during periods of inclement weather, even where employees either remain on site or are sent home. Employees are not expected to remain on site for more than half of the remainder of the day where inclement weather is agreed.
Conference Requirement and Procedure. (a) The Employer shall when requested by the safety representative of the Employees, confer within a reasonable period of time with the safety representative for the purposes of determining whether or not conditions are inclement weather.
(b) At any conference held under clause 24.2(a):
(i) conditions shall not be regarded as inclement weather unless it is agreed at such conference; and
(ii) if it is agreed that the conditions are inclement weather, consideration shall be given to the manner in which work may continue in a manner that will minimise the risk to the health and safety of any Employee exposed to the inclement weather. Particular regard shall be given to the manner of completion of any commenced or emergency work.
