Non-Discrimination; Equal Employment Opportunity. 6.2.1 Maintenance Contractor shall not, and shall cause the Subcontractors to not, discriminate on the basis of race, color, national origin or sex in the performance of the Maintenance Services under the CMA Documents. Maintenance Contractor shall carry out, and shall cause the Subcontractors to carry out, applicable requirements of 49 CFR Part 26. Failure by Maintenance Contractor to carry out these requirements is a material breach of this Capital Maintenance Agreement, which may result in the termination of this Capital Maintenance Agreement or such other remedy as TxDOT deems appropriate.
