Non-Employment of COUNTY Personnel. 25 1. A/E agrees that no full-time, regular employee of COUNTY who 26 is involved in this Project shall be given or offered employment by A/E in a 2 assignments said employee may be given or the days or hours employee may 3 work. By accepting this AGREEMENT, A/E agrees not to negotiate any 5 involved in this Project in professional classifications of the same skills 6 required for the performance of this AGREEMENT. 7 2. Nothing in this AGREEMENT shall be deemed to make A/E, or any 8 of A/E’s employees or agents, the agents or employees of the COUNTY. A/E 9 shall be an independent contractor and shall have responsibility for and 10 control over the details and means for performing the work, provided that A/E 11 is in compliance with the terms of this AGREEMENT. Anything in the AGREEMENT 12 which may appear to give COUNTY the right to direct A/E as to the details of 13 the performance of the work or to exercise a measure of control over A/E 14 shall mean that A/E shall follow the desires of COUNTY, only in the results 15 of the work.
