Employment of Consultant. CONSULTANT will perform as an independent contractor all services under this Contract to the prevailing professional standards consistent with the level of care and skill ordinarily exercised by members of its profession, both public and private, currently practicing in the same locality under similar conditions, including reasonable, informed judgments and prompt, timely action. If CONSULTANT is representing that it has special expertise in one or more areas to be utilized in this Contract, then CONSULTANT agrees to perform those special expertise services to the appropriate local, regional or national professional standards.
Employment of Consultant. The CITY hereby engages the CONSULTANT and the CONSULTANT hereby agrees to perform the professional services hereinafter set forth.
Employment of Consultant. District hereby contracts with consultant to perform the necessary professional services and advice as hereinafter set forth.
Employment of Consultant. For and in consideration of the covenants herein contained, CONSULTANT hereby covenants and agrees as an independent contractor, to perform the services herein described with diligence and in a manner consistent with the level of care and skill normally exercised for such professional planning, platting, engineering, surveying, and landscape architectural services in the State of Texas. CONSULTANT agrees to perform professional planning, surveying, cost estimating, and landscape architectural services in connection with the Project as set forth below, and CITY agrees to pay, and CONSULTANT agrees to accept, fees as set forth in this Contract as full and final compensation for all services performed under this Contract. If CONSULTANT is representing that it has special expertise in one or more areas to be utilized in this Contract, then CONSULTANT agrees to perform those special expertise services to the appropriate local, regional and national professional standards. CONSULTANT shall provide professional planning, platting, engineering, surveying, and landscape architectural services to design and prepare plans and specifications for the Rush Creek Mitigation Area, being located within the City of Arlington, Tarrant County, Texas, and hereinafter referred to as the “Project.”
Employment of Consultant. For and in consideration of the covenants herein contained, CONSULTANT hereby covenants and agrees as an independent contractor, to perform the services herein described with diligence and in a manner consistent with the level of care and skill normally exercised for such professional services in the State of Texas. CONSULTANT agrees to perform professional services in connection with the Project as set forth below, and CITY agrees to pay, and CONSULTANT agrees to accept, fees as set forth in this Contract as full and final compensation for all services performed under this Contract. If CONSULTANT is representing that it has special expertise in one or more areas to be utilized in this Contract, then CONSULTANT agrees to perform those special expertise services to the appropriate local, regional and national professional standards. CONSULTANT shall provide professional services for design, engineering, surveying and development of construction documents trail improvements at Xxxxxxx Park, being located within the City of Arlington, Tarrant County, Texas, and hereinafter referred to as the “Project.”
Employment of Consultant. The City retains the Consultant to provide the services described in Exhibit A – Scope of Work incorporated herein, (“collectively “Scope of Work” or the “Work”). Any inconsistency between this Agreement and the Scope of Work shall be resolved in favor of this Agreement. The Consultant shall perform the Work according to the terms and conditions of this Agreement.
Employment of Consultant. A. Consultant shall perform on-call Transportation, Traffic, Engineering, and related Services as set forth in this Agreement and a Supplemental Agreement (hereafter "Supplemental Agreement"). The Supplemental Agreement is made a part of this Agreement as if fully set forth herein. City shall pay Consultant for the performance of Services in the manner set forth herein and in the Supplemental Agreement.
B. Requests for services made by the City to Consultant are contingent upon execution of a Supplemental Agreement and the sufficiency of funding. No services shall commence on a particular project until a Supplemental Agreement has been executed by both parties, and City has notified Consultant to proceed as set forth in Section IV below.
Employment of Consultant. A. The City retains the Consultant to provide the services described in Exhibit C” (the “Work”). Any inconsistency between this Agreement and the Scope of Work shall be resolved in favor of this Agreement. The Consultant shall perform the Work according to the terms and conditions of this Agreement.
B. The City may revise the Work and the compensation only by a written Change Order signed by the authorized City representative that shall become a part of this Agreement.
C. The project manager(s) of the Work shall be Xxxxx Xxxxxxx, P.
E. The project manager shall not be replaced without the prior written consent of the City. Work shall commence when the City issues a notice to proceed and it shall be completed no later than December 31, 2020, unless the completion date is extended in writing by the City.
Employment of Consultant. TAMC hereby engages Consultant and Consultant hereby agrees to perform the services set forth in Exhibit A, in conformity with the terms of this Agreement. Consultant will complete all work in accordance with the work schedule set forth in Exhibit A.

(b) Consultant represents that Consultant and its agents, subcontractors and employees performing work hereunder are specially trained, experienced, competent, and appropriately licensed to perform the work and deliver the services required by this Agreement.
(c) Consultant, its agents, subcontractors, and employees, shall perform all work in a safe, skillful, and professional manner and in compliance with all applicable laws and regulations. All work performed under this Agreement that is required by law to be performed or supervised by licensed personnel shall be performed in accordance with such licensing requirements. Consultant shall ensure for itself and for any subcontractors under this Agreement that the applicable requirements of Labor Code section 1725.5, concerning the registration of contractors for public works, shall be in force and maintained for the term of this Agreement.
(d) Consultant shall furnish, at its own expense, all materials and equipment necessary to carry out the terms of this Agreement, except as otherwise provided herein. Consultant shall not use TAMC premises, property (including equipment, instruments, or supplies) or personnel for any purpose other than in the performance of its obligations hereunder.
(e) Consultant’s project manager shall be the person specified in Exhibit A. If Consultant desires to change the project manager, Consultant shall get written approval from TAMC of the new project manager. (f) Consultant shall submit progress reports at least once a month. The report should be sufficiently detailed for the Contract Administrator to determine, if Consultant is performing to expectations, or is on schedule; to provide communication of interim findings, and to sufficiently address any difficulties or special problems encountered, so remedies can be developed.
(g) Consultant’s Project Manager shall meet with TAMC’s Contract Administrator, as needed, to discuss progress on the contract.
Employment of Consultant. The WFRC hereby agrees to engage CONSULTANT, and CONSULTANT hereby agrees to perform the services identified in Attachment A based on the budget in Attachment C.
