Fixed Term Employees. The only terms of this Agreement that apply to employees who are not regular employees are those that are set out in Articles 31A, 32, 33 and 34. 31A.1 Articles 31A.2 to 31A.16 apply only to fixed-term employees other than seasonal, student and GO Temp employees.
Fixed Term Employees. (a) Notwithstanding the other provisions contained in this clause the Employer may employ employees for a fixed term.
(b) Employees appointed for a fixed term will be advised in writing of the terms of the appointment and such advice will specify the dates of commencement and termination of employment.
(c) The provisions of subclause 14.6 will also apply in respect to fixed term employees.
Fixed Term Employees. A fixed term employee is a person who is initially employed for a period of not more than 6 months, which fact shall be recorded in a letter to the employee at the time of the engagement. Should it be necessary to continue to engage the employee beyond the six months, the employee shall be offered permanent employment unless there is a clear and compelling reason not to. Such clear and compelling reason will be documented and agreed at the time of the extension.
Fixed Term Employees. (a) Except as outlined below a fixed term employee shall be regarded as permanent for the operation of the terms of this agreement when:
(i) The appointment is for more than one year; or
(ii) Each period of fixed term service within a single 12 month period adds up to one year's service.
(b) The provisions for fixed term employees employed for less than a year, will be the same as for permanent employees or as specified in the appropriate clause or section.
(c) If a fixed term employee is working in place of a permanent employee, the fixed term employee will be advised that the period of employment is dependent on the notification of the date of return of the permanent employee.
(d) Transfer and travel expenses in taking up the position shall be as for other employees i.e. by negotiation and agreement between the employer and employee or agent including assistance to and/or from the location.
(e) Expenses incurred in the carrying out of official business shall be as for other employees i.e. reimbursement on an actual and reasonable basis.
Fixed Term Employees. A fixed term Employee is one who has been hired to perform duties in connection with a specified task, or for a specified duration and whose employment will end on completion of that task or the completion of the fixed period of time. A fixed term Employee shall for all purposes of this Agreement be otherwise treated as a permanent full-time or part-time Employee as applicable.
Fixed Term Employees. 6.1 The only terms of this Agreement that apply to employees who are not regular employees are those that are set out in this Article.
6.2 The following sections in this Article shall apply only to fixed term employees.
Fixed Term Employees a) Employees may be initially engaged for a fixed term, subject to all of the following conditions being satisfied:
i. The fixed term employee is not an existing employee.
ii. The work the fixed term employee is being engaged to do is unique work. Unique work shall be determined by agreement between the parties. Agreement will not be unreasonably withheld.
iii. The exact starting date and finishing date and whether the fixed term employee is a full-time or part time employee, is provided to the employee prior to commencing employment.
iv. The length of the fixed term does not exceed 12 months duration or longer by agreement.
v. The fixed term employee has not previously been engaged on a fixed term in the past 12 months.
b) For clarity, fixed term employees are entitled to notice of termination and Protect severance pay as set out within this agreement and all other entitlements of permanent ongoing employees. However, they shall not be set out to the redundancy process at clause 28.3 of this agreement.
Fixed Term Employees. 7.5.1 An employee can only be recruited on a fixed term basis when it is likely that the employee’s service will be required only for a specific period for the purposes of:
(a) recruitment for a specific project or task to provide special skills which are not encompassed by current operational roles;
(b) filling temporary resource needs resulting from specific employee circumstances;
(c) facilitating workforce adjustment/ transition strategies for implementation of change or acceptance of new business opportunities. These will be the subject of consultation in accordance with clause 33 and that consultation will include any expected need to use fixed term employees; and
(d) other circumstances agreed between Australia Post and the relevant Union or determined by the FWC.
7.5.2 A fixed term employee will not be held against a permanent vacant position unless the reason for employing the fixed term employee against such a position meets the requirements of clause 7.5.1.
7.5.3 The period of continuous employment as a fixed term employee can be up to one year but can be extended beyond one year in particular circumstances for further periods:
(a) all extensions are subject to approval through the relevant Business Unit or Head of Human Resources and in consultation with the Union;
(b) extensions greater than a further one year (a period of continuous employment greater than two years) must be by agreement with the Union.
7.5.4 Extensions of fixed term employment will, in most circumstances, be limited to planning for known impacts of major change projects and employment breaks (as defined under clause 28.2(a)(v)).
7.5.5 Where the services of a fixed term employee are terminated before the expiry of the period fixed by the terms of engagement, the employee is entitled to notice in accordance with section 117(3) of the FW Act.
7.5.6 Fixed term employees who have been subject to the same selection processes that apply to permanent employees, will, subject to satisfactory service, be given priority if any permanent base level vacancies are filled by external recruitment during the fixed term period (subject to clause 7.2.7).
Fixed Term Employees. An employee may be engaged as a Fixed Term employee for up to a maximum of three (3) months. Ordinary hours for Fixed Term employees will be:
a) 38 hours per week;
b) up to 7.6 hours per day;
Fixed Term Employees. The purpose of employing fixed term employees is to fill positions of a project of limited term as designated by the Director-Human Resources or ordinance of the Board of Supervisors. Sec. 1103 Limitations: A. Extra Help Employment - No extra help employee may be employed unless the Director-Human Resources finds that the conditions set forth in Section 1102(A) are present. No extra help employee may be employed to fill a classified position for more than thirty (30) working days other than provided for in Section 1105, if there are at least three (3) persons eligible to be certified by the Director-Human Resources for that vacancy. No person shall be employed as an extra help employee for any purpose for more than 720 hours in any one fiscal year. The Director-Human Resources may grant special authorization upon extenuating circumstances to extend extra help employment periods after receiving written justification from the appointing authority. Such special authorization shall be in writing to the appointing authority and copies shall be sent to the Auditor/Controller and any appropriate employee organization. The Auditor/Controller shall not authorize payment to any extra help employee over 720 hours without such special authorization form the Director-Human Resources. Whenever it is determined that the extra help employee does not meet the same qualifications required for regular classified employees, he shall be terminated from County employment.
