Common use of Non-Interruption of Service Clause in Contracts

Non-Interruption of Service. Successful Respondent acknowledges and agrees that any interruption to the Service may cause irreparable harm to DIR and/or the DIR Customers and may adversely impact the ability of the State to carry out vital public safety and other governmental functions (including homeland security matters), in which case an adequate remedy at Law would not be available. Except to the extent expressly permitted under Chapter 2251, Texas Government Code, Successful Respondent expressly acknowledges and agrees that, pending resolution of any dispute or controversy, it shall not deny, withdraw, or restrict Successful Respondent’s provision of the Services to DIR and/or the DIR Customers under this Agreement.
