NON-WAIVER CLAUSE. The waiver by either party of any breach of any provision of this Agreement by the other shall not be construed as a waiver of any subsequent breach by the other or as a waiver of any other clause of this Agreement.
NON-WAIVER CLAUSE. The failure by one party to require performance of any provision shall not affect that party’s right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Contract constitute a waiver of any subsequent breach or default or a waiver of the provision itself. CLIENT has read both pages of the AGREEMENT and agrees to all the terms and conditions of the AGREEMENT.
NON-WAIVER CLAUSE. The failure of either party to insist upon strict performance of any provision of this Agreement shall not be deemed a waiver of the right thereafter to insist upon performance of that or any other provisions of this Agreement.
NON-WAIVER CLAUSE. No waiver by either Party of any nonperformance or violation by the other Party of any of the covenants, obligations or agreements of such other Party hereunder shall be deemed to be a waiver of any subsequent violation or non-performance of the same or any other covenant, agreement or obligation, nor shall forbearance by either Party be deemed to be a waiver by such Party of its rights or remedies with respect to such violation or nonperformance. The headings in this Agreement are inserted for the convenience of the Parties only and may not be used in the interpretation of any provisions hereof.
NON-WAIVER CLAUSE. During the effective term of the guarantee, the Bank’s tolerance of any default or delaying of Borrower and Guarantor, extension or delay in performing Facility Agreement and interests or rights of the Bank under the guarantee shall not damage, impact or restrict interests and rights of the Bank as the creditor according to applicable law and this guarantee, and are not deemed as waiver of the right to take actions for current or future default.
NON-WAIVER CLAUSE. It is understood and agreed that any delay, waiver or omission by the General Contractor or the Contractor to exercise any right or power arising from any breach or default by the other party of any of the terms or provisions of this Agreement shall not be construed to be a waiver by the General Contractor or the Contractor of any subsequent breach or default of the same or other terms or provisions on the part of the other party.
NON-WAIVER CLAUSE. The failure by any Party at any time to enforce any of the terms or provisions or conditions of this Agreement or exercise any right hereunder shall not constitute a waiver of the same or affect that Party's rights thereafter to enforce or exercise the same. No waiver of any of the provisions of this Agreement shall be deemed binding unless executed in writing by the Party to be bound by it.
NON-WAIVER CLAUSE. No waiver by Lessor of any default by Lessee shall be effective unless in writing or operate as a waiver of any other default or of the same default on a future occasion. Lessor’s acceptance of rent shall not be deemed a waiver as to any proceeding default.
NON-WAIVER CLAUSE. The failure of the Company or the Reinsurer to insist on compliance with this Agreement or to exercise any right or remedy hereunder shall not constitute a waiver of any rights or remedy contained herein nor stop either party from thereafter demanding full and complete compliance nor prevent either party from exercising such rights or remedy in the future.
NON-WAIVER CLAUSE. In case any of the Parties overlooks and/or pardons any non-fulfilment, breach, default and/or non-compliance with any and all obligations arising out of or in connection to the Agreement, such conduct does not constitute waiver of any right or release from any obligation in respect to its continuing or subsequent non-fulfilment, breach or non-compliance and no such pardon shall be deemed in effect unless given in written and for every single occasion.
