Nonpayment by Granite. 1.9.1 If payment of undisputed amounts due pursuant to Section 1.5, is not received in immediately available funds by the bill date in the month after the original bill date, AT&T-9STATE will provide written notice to Granite that additional applications for Services may be refused, that any pending orders for Services may not be completed, and/or that access to ordering systems may be suspended if payment of such amounts, and all other amounts that become past due before refusal, incompletion or suspension, is not received by wire transfer by the fifteenth day following the date of the notice. In addition, AT&T-9STATE may, at the same time, provide written notice to the person designated by Granite to receive notices of noncompliance in Section 1.11 that AT&T- 9STATE may discontinue the provision of existing Services to Granite if payment of such amounts, and all other amounts that become past due before discontinuance, is not received by wire transfer or cashier’s check by the thirtieth (30) day following the date of the initial notice.

  • Notice of Nonpayment The Trustee shall notify the Grantor and the NDEQ Director by certified mail, return receipt requested, within 10 days following the expiration of the 30-day period after the anniversary of the establishment of the Trust, if no payment is received by the Grantor during that period. After the pay-in period is completed, the Trustee shall not be required to send a notice of nonpayment. Section 16.

  • TERMINATION BY MPS - BREACH BY CONTRACTOR If Contractor fails to fulfill its obligations under this Contract in a timely or proper manner, or violates any of its provisions, MPS shall thereupon have the right to terminate it by giving five (5) days written notice before the effective date of termination of the Contract, specifying the alleged violations, and effective date of termination. The Contract shall not be terminated if, upon receipt of the notice, Contractor promptly cures the alleged violation with five (5) days. In the event of termination, MPS will only be liable for services rendered through the date of termination and not for the uncompleted portion, or for any materials or services purchased or paid for by Contractor for use in completing the Contract.

  • Events of Default by Either Party It shall constitute an event of default (“Event of Default”) by either Party hereunder if:

  • Default by City City shall not be in default under this Agreement unless City fails to perform an obligation required of City under this Agreement within twenty (20) days after written notice by Tenant to City.   • Default by State If the State, sixty (60) days after receipt of written notice, fails to correct or cure any material breach of this Contract, the Contractor may cancel and terminate this Contract and institute measures to collect monies due up to and including the date of termination.
