Notice Costs Sample Clauses

Notice Costs. The Developer will be responsible for and shall pay all costs related to providing notice and advertising this Agreement under Section 163.3225, Florida Statutes, and the recording of this Agreement.

Notice Costs. Plaintiffs' counsel in the Settling Derivative Actions shall be responsible for funding and administering appropriate court-directed individual notice to the shareholders of Hanover entitled to receive such notice, as well as any other required or appropriate notice to be made by publication or otherwise.

Notice Costs. All Notice Costs shall be paid by Xxxxxx or its successor(s)-in-interest, regardless of whether the Court finally approves the Settlement of the Derivative Claims, and in no event shall the Pearl City Parties, the General Governors, their attorneys, or Xxxxxx’ Counsel be responsible for any Notice Costs.

Notice Costs i. All costs for Notice under this Amended Settlement Agreement shall be initially paid by the PSC but will be taxed as costs incurred by the Special Master. Such costs include but are not limited to the costs of the Notice Agent, publication of the Notice, the costs associated with producing and mailing the Notice, and with making the package available by the other means consistent with this Section. The cost of Notice to the Class initially paid by the PSC will ultimately be paid from the Settlement Fund after the Effective Date of the Settlement subject to the limitations of Section XV.D and XV.F, and Court approval.

Notice Costs. Each Party will assume administrative responsibility for and will each pay its respective costs and expenses related to publishing and disseminating the Notice in accordance with paragraph 4 above, as well as any costs and expenses related to the administration of the Settlement.

Notice Costs. VIA will assume all the costs of disseminating and publishing the Notices in accordance with the terms of the Settlement.

Notice Costs. Defendant recognizes and understands that the funds necessary to pay for the issuance of the Settlement Class Notices (defined infra § 18) may be required before the Settlement Class Notices are distributed to Class Members, and that any such payment shall be included in, and not in addition to, the total Settlement Amount of $7,000,000 noted above. Defendant agrees to pay for the issuance of the Settlement Class Notices as part of the Settlement Amount before full funding, as described herein.

Notice Costs. The cost of issuing the Pre-Approval Notice and Post-Approval Notices will be paid by the Respondents.

Notice Costs. The Defendants shall pay all reasonable notice costs as part of the Administration Expenses up to a maximum of CAD $25,000 in addition to the Maximum Settlement Funding. Any additional Administration Expenses will come out of the Maximum Settlement Funding.
